Description
LIMITED-SOURCES JUSTIFICATION In accordance with the authority granted under 41 U.S.C. 253(c), this request for award under other than full and open competition is hereby submitted. (i). Identification of the agency and the contracting activity, and specific identification of the document as a "Limited-Sources Justification": Bureau of Land Management St. George Field Office 345 East Riverside Drive St. George, U T 84790 (ii). Nature and/or description of the action being approved: Professional Services are required to facilitate the completion of a Draft Comprehensive Travel and Transportation Management Plant (DTMP) Environmental Assessment (EA). Select services shall include the analysis of public comments and a biological assessment for the DTMP. The DTMP EA is currently in development by Advanced Resource Solutions. The nature of this work is for an additional scoping of public comments and Biological Assessment that was not anticipated when the original requirement was put together. These are additional services to be rendered in completing the work already in progress. (iii). A description of the supplies or services required to meet the agencys needs (including the estimated value): Services required include analysis of public comments generated by the DTMP EA and a Biological Assessment (BA) for the DTMP EA. A more detailed scope for both tasks is as follows: 1. Public Comments on DTMP: Gather and analyze approximately 6000 public comments on the DTMP EA including categorizing, assigning keywords, and developing a searchable database in a format acceptable to BLM. Every comment will be addressed, either individually or by appropriate category. Attendance at three public workshops to be held in St. George, Hurricane and Salt Lake City shall be required. Deliverables include a searchable database of all public comments received including the BLMs response. The completed database is required 120 days after the close of the public comment period. The Governments Estimate for this work is $27,500.00 2. BA for DTMP: Prepare a BA addressing the impacts of implementing the preferred alternative selected in the DTMP EA. The BA shall be prepared according to guidance developed by U.S.Fish and Wildlife Service and shall be in compliance with Section 7 of the Endangered Species Act. Deliverables shall include a Draft BA for internal BLM review and a final BA addressing BLMs comments to the agencys satisfaction. The Final BA is required at contract closeout. The Governments Estimate for this work is $33,000.00 (iv). The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractors unique qualifications to provide the required supply or service. 41. U.S.C. 253(c) (1) as implemented by FAR 6.302-1 (a)(2). ARS is the industry leader in providing travel management services that meet the needs of the BLM, and have the capacity as well as a software database no other company provides to date to document and facilitate the travel route inventory and planning process to properly comply with the BLM CFRs and regulations. BLM in Utah is using ARS for the St.George planning process to facilitate the inventory and travel planning. This work was not anticipated before execution of the complementary contract was begun. Because this work is outside the scope of the original contract it was determined that a separate requirement was needed. (v). A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d). Using ARS provides the best value to the BLM because they posess the skills and software products that produce deliverables that comply with BLM CFR's and guidance in the most efficent and consistent manner. ARS has proven themselves as the industry leader and in delivering a product that is defensible when challenged in the legal realm. (vi). A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research was limited since ARS is the only company that can provide this service and the database and software is proprietary to ARS. ARS has demonstrated the ability to provide the unique requested services to properly comply with BLM CFRs and relevant guidance. (vii). Any other facts supporting the justification. All costs will be determined to be fair and reasonable by the procurement officer based on historical purchase history of similar work performed by ARS. (viii). A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. There are no actions the BLM may take at this time as ARS is the sole provider of the services needed for the deliverables needed by the BLM. (ix). The ordering activity contracting officers certification that the justification is accurate and complete to the best of the contracting officers knowledge and belief. The justification is accurate and complete of the services needed to the best of the contracting officers knowledge and belief. (x). Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Governments minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel. Evidence provided by the technical or requirements personnel form a basis for this justification.
