- The United States Government intends to solicit and negotiate with only one source under the authority of FAR 13.501(a),Only One Responsible Source and no Other Supplies or Services Will Satisfy Agency Requirements based on proprietary issues. Due to several corporate mergers, the only manufacturer and distributor of ATDs is Humanetics Innovative Solutions. Humanetics also holds all intellectual property (IP) rights including several patents to these products prohibiting the manufacturer from another source. Calibration, service, repair, and modification of existing and replacement parts and ATDs require knowledge that only Humanetics possesses as IP holder. The Government intends to solicit and negotiate with Humanetics Innovative Solutions, 47460 Galleon Drive, Plymouth, MI 48170 for Anthropomorphic Test Devices (ATD), parts, calibration, repair, modification and development. The objective is the procurement of ATDs, ATD and measurement components, maintenance, calibration, technical support, ATD repair and replacement parts, including development and prototyping of new designs and manufacturing of new and existing ATD components. This notice of intent is not a request for competitive proposals. However, any responsible source who believes it is capable of meeting the requirement may submit a capability statement, proposal, or quotation, which shall be considered by the agency, only if received by the closing date and time of this notice. A determination not to compete the proposed requirement based upon the responses to this notice is solely within the discretion of the Government.
