- Notice of Intent to Sole Source The Food and Drug Administration intends to award a sole source contract to Liberty Lock And Security, Inc located at 1205 Taft St, Rockville, MD, 20850-1344. In accordance with FAR part 6.302-1, there is only one responsible source and no other supplies or services will satisfy agency requirements. The purpose of this acquisition is to replace all lock cores / keyways / key systems that are currently proprietarily owned and/or licensed by Liberty Lock and Security with devices that will be owned by/licensed to the FDA, as well as providing locksmith services during the conversion. Since FDA has no ownership/license for these proprietary products, only Liberty Lock and Security, Inc. has the ability to switch out and replace these devices while maintaining the physical security of FDA buildings and personnel safety. Currently, the proprietary ownership/licenses for the locking devices in place are non-transferable to any other entity. It was recently discovered that the issues of non-transferable proprietary usage and/or non-transferable licensing for usage created a non-competitive acquisition environment. The intent and outcome of this contract will result in the FDA having the documentation and ownership/use (license and proprietary) of its lock cores / keyways / key systems and the ability to create a competitive environment for future locksmith services. The associated NAICS Code is: 561622 - Locksmith services with or without sales of locking devices, safes, and security vaults. This notice is neither a request for competitive proposals, nor is this a request to identify sources for general locksmith services. Any party that believes it is capable of meeting this requirement as stated herein may submit a written capability statement that clearly supports and demonstrates their ability to perform the requirement to include addressing their ability to remove, replace, and manage locking devices for which non-transferable licenses / proprietary usage is currently held by a third party. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they can meet the requirement. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. It is anticipated that an award will be issued to Liberty Lock and Security, within approximately 45 days after the date of this notice unless the Government determines that any other organization has the capacity to meet this requirement.
