- SECTION B - CONTINUATION BLOC K PRICE SCHEDULE FOR AUDIOLOGIST This procurement is conducted pursuant to the authority of Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, FAR 37.101, Non-Personal Service Contract. The Billings Area Indian Health Service (IHS) intends to award a fixed-price purchase order in response to Request for Quotation (RFQ) 10-12-019-JH to acquire an Audiologist for the Blackfeet Service Unit, PHS Indian Hospital, Browning, MT and Heart Butte Clinic, Heart Butte, MT. The solicitation is restricted to 100% Small Business concerns. The Solicitation clauses and provisions are those in effect through Federal Acquisition Circular 2005-75. The associated North American Industry Classification System code is 621340 and the small business size standard is $7.0 million. Potential offerors are asked to submit an offer. The proposed daily rates must be inclusive of transportation, food, lodging, et cetera. PRICE SCHEDULE - AUDIOLOGIST SERVICES BLACKFEET SERVICE UNIT: 1. 36 CLINIC DAYS @ $ per day = $ _________________.GRAND TOTAL................................. $__________ _ PERIOD OF PERFORMANCE Performance of this purchase order shall be from time of award through September 30, 2014. INTRODUCTION AND PURPOSE OF THE CONTRACT: The services are to be provided at the Blackfeet Service Unit, PHS Indian Hospital, Browning, MT and Heart Butte Clinic, Heart Butte, MT. The purpose of the contract is to acquire direct diagnostic and rehabilitative audiologic services. The procurement is a nonpersonal health care service contract, as defined in FAR 37.101, under which the Contractor is an independent contractor. The Government may evaluate the quality of professional and administrative services provided but retains no control over the medical and professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment). The Contractor shall indemnify the Government for any liability producing acts or omissions by the Contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the medical specialty concerned. The Contractor is required to ensure that its subcontracts for provisions of health care services contain the requirements of the clause at 52.237-7, including the maintenance of medical liability insurance. STATEMENT OF WORK STATEMENT - PROGRAM OBJECTIVES: 1. The Audiologist will provide 36 days of direct diagnostic and rehabilitative audiologic services to the Blackfeet Service Units. The Audiologist will provide services included but not limited to: audiologic screening, evaluation, hearing and evaluations and fitting, aural rehabilitation, consultations and program development and evaluation. 2. The Audiologist will perform physical examinations, health assessments and treatment of varying extremes in individuals presenting themselves for care to the Blackfeet Community Hospital Audiology program; assesses and diagnoses disorders to the ear, nose and throat on patients of all ages in order to provide treatment or make appropriate referrals. Refers individuals for consultation when indicated; prescribes and carries out therapy in conformation with approved clinical privileges and Billings Area Indian Health Services policies. 3. The Audiologist conducts initial and periodic health examinations for finding physical defects in need of correction and prescribes and implements treatments required to correct these defects. 4. The Audiologist is responsible for the selection, provision and interpretation of comprehensive audiologic evaluations to include the following: Air and bone conduction testing; Speech reception and discrimination testing Immittance testing; Auditory Brainstem response testing, Otoacoustic Emissions testing; Soundfield testing; Play Audiometry; and other Site-of-Lesion tests. 5. The Audiologist is responsible for providing comprehensive audiologic rehabilitation services to include but not limited to : Hearing aid evaluations; Hearing Aid Orientations; Aural rehabilitation; hearing aid fittings and follow-ups; counseling the hearing impaired person, his/her family and other pertinent persons to help alleviate the effects of the hearing impairment. 6. Upon request and approval the Audiologist will participate in the Universal Newborn Hearing Screening Program at the Blackfeet Service Unit. This includes but not limited to: Training and Monitoring Nurses for the initial screenings importing data to the State of Montana HiTract software, and making appropriate referrals for diagnostic evaluation of newborns referred from re-screenings. The Audiologist is responsible in maintaining inventory and accessories needed to provide a fully functioning hearing aid practice at each Service Unit. 7. The Audiologist will provide the necessary paperwork required to the Area Audiologist Program such as hearing aid repairs, hearing aid and ear mold order forms; requesting hearing aid and audiology supplies; completed vouchers for hearing aids; and complete a "Hearing Aid File" card on each hearing aid dispensed. 8. The Audiologist will properly record audiology services in the patients' medical record or electronic health record or EHR to assess audiology needs and provide the required audiology care. 9. The Audiologist will prepare the patient for otologic examinations, audiologic testing and treatment. 10. The Audiologist will maintain inventory and calibration of audiologic equipment. 11. The Audiologist will provide audiologic services for specialty clinics such as Ear-Nose-Throat (ENT), Facial Anomalies clinic and provide all necessary pre- and post-operative evaluations on all otologic surgical patients. 12. The Audiologist will establish hearing conservation programs, in-service training to nurses, physicians, and other appropriate staff; Maintenance Department; Dentists; and serve as a consultant to the Head Start program, all when necessary. 13. The Audiologist will act as an intermediary between the patient, Service Unit personnel, Tribal personnel, Area Audiology Program personnel, State and Federal agencies. 14. The Audiologist will maintain a current state license, as required, by continuing education activities (CEUs). 15. The Audiologist will participate and provide the Office of Healthcare Programs an invoice after delivery of service every month. 16. The Audiologist will participate and provide quarterly chart reviews as randomly selected by the Service Unit to evaluate audiology services. The evaluation should be given to the appropriate Contractor Officer Representative by the end of each quarterly month. These services will include audiologic screenings, hearing evaluations, hearing aid evaluation, hearing aid fittings, hearing aid repairs, ect. Record patient-provider encounters in the chart in a legible manner for accurate communication between the providers and completes require ADMINISTRATIVE DUTIES: 1. The Audiologist will provide professional leadership and program direction in administrative practices related to audiology services to insure fulfillment of the Service Unit's goals and objectives by setting and maintaining standards for the clinical practice of Audiology. In addition provides program consultation to assist Service Unit; and other federal, state and local agencies. 2. The Audiologist has the responsibility to act as an intermediary between patients, Service Unit personnel, Tribal personnel, and Billings Area Office personnel, as well as the expert resource for referring patients to other facilities, and local, State and Federal agencies. 3. The Audiologist is the authoritative expert and program consultant to assist and evaluate the Universal Newborn Hearing Screening Program at the Blackfeet Community Hospital, MT and Heart Butte Clinic, Heart Butte, MT. This includes but not limited to: Yearly training and observations of screening procedures with the nursing staff for compliance documentation; assisting in tracking and reporting data to the State of Montana; and receiving referrals from the Program to confirm possible hearing loss. 4. The Audiologist has the responsibility to design, initiate and evaluate audiological services at the request of the Service Units or Health Care Supervisor. This may include quality assurance peer review of medical records/EHR, establishing criteria for services, coordination of services, developing policies and standards, assessing the needs, program trends and the effective use of services for the highest achievable quality of services. 5. The Audiologist will review Service Unit's audiologic equipment regularly for replacement and updating. Submit request of supplies or recommendation of equipment to the Service Unit with estimate of cost as needed. 6. The Audiologists will participate in professional societies to keep abreast of new developments in audiology, review current literature, and view demonstrations of new equipment and procedures. Be able to integrate policies and procedures from American Speech Language Hearing Association (ASHA), American Academy of Audiology (AAA) and other accreditation organizations such as Joint Commission with the Billings Area mission, vision and goal by strategic planning, budgeting, and conducting meetings with Communication Disorder Program to keep staff abreast of work requirements, methods and procedures as needed. KNOWLEDGE BY REPORTING REQUIREMENTS: 1. Knowledge of established professional audiologic concepts, principles, and practices; and otologic diseases necessary to assess the extent of a hearing disorder and its effect upon communication, health, vocation, and socialization for appropriate treatment or referral. 2. Knowledge of Communication Disorders Program policies and practices as well as cultural, social and economic characteristics of the Native population relative to adapting, redesigning or modifying audiology principles to the varied population. 3. Knowledge of the relative value for audiologic evaluations and the principles and practices that govern the evaluations to serve as technical authority, expert advice and direction about the audiological aspects of the health care delivery system. 4. Knowledge of the current VA hearing aids on contract, standards and advances in hearing aid fittings, ear mold modifications, frequency response, and other electro-acoustic modifications. Knowledge of aural rehabilitation procedures to provide appropriate amplification and counseling to the hearing impaired. Also familiar with ANSI standards of calibration. 5. Knowledge of Privacy Act and HIPAA regulations of patient confidentiality. 6. Skills in oral and written communication to maintain effective working relationships at the Service Units, Billings Area Office, Tribal personnel, vendors, contractors, and other Federal, State and local agencies. 7. Knowledge of medicinal therapy and pharmacological practices and a comprehensive understanding of otorhinlaryngological. A DEA license with current certifications for BLS is also required. 8. Specialist in evaluation, habitation, and rehabilitation of those whose communication disorders center in whole or in part in the hearing function. involving diagnosis and treatment loss as well. PHYSICAL DEMANDS The work requires some physical exertion and stamina including extensive walking, standing, bending, sitting and other activities. The incumbent may be required to assist with lifting patients at times. The incumbent maybe required remain awake and on duty for prolonged periods of time. WORK ENVIRONMENT: The work is performed in a clinical setting and is environmentally controlled with occasional driving to the outlying clinic. SUPERVISORY CONTROLS : Immediate supervision is provided by the Clinical Director or designee will monitor workload to determine that major duties as in the statement of work are address. Extreme illness and trauma cases, which are beyond the protocols and capability of the facility are referred to a consulting/attending physician at an off - site facility GUIDELINES: Guidelines available include DHHS, PHS, I.H.S., Billings Area, Service Unit and Medical Staff regulation, policies, procedures, and bylaws. In addition, traditional and currently accepted medical practices are available in the form of specialty consultation, medical journals, professional organizations and textbooks. In nearly all cases, however, the medical practitioner's judgment t is the key factor in determining whether guidelines are to be adhered to or deviated or whether new guidelines need to be development to protect the interest of the patient. COMPLEXITY: The work consist of broad general practice of medicine, involving diagnostic and treatment of outpatient with an extremely wide variety of physical and emotional problems and includes the broad functions of medicine, education, prevention, cure and rehabilitation, in addition to the practice within the specialty of Audiology. GOVERNMENT FURNISHED PROPERTY: Purchasing Agent /Supply Technician shall provide the contractor with an initial orientation regarding all aspects that pertains to their employment as a non-personal service contract employee, the layout of the facility and information on the role IHS has on the Indian communities being served. All Child care National Agency Check and investigation (CNACI) forms will be provided by IHS. The department will orientate the contractor as to their specific duties and responsibilities. The department will provide the contractor with standard and specialized equipment and supplies needed for the performance and delivery of services including the use of a computer. The department is responsible for getting the contractor access and provide orientation to the Contractor as to their specific duties and responsibilities. The Department is responsible for getting the Contractor access and clearances to all pertinent computer services necessary to carry out his/her duties. If necessary, authority to use a General Services Administration (GSA) vehicle, for Official purpose only. The Contractor will be required to provide evidence of motor vehicle liability insurance covering bodily injury and property damage to protect the Contractor and the Government against third party claims arising from the operation offall GSA vehicle used In connection with the contract. The Contractor shall provide coverage of at least $200,000 per Person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for Property Damage. The Contractor shall comply with the requirements of FAR subpart 51.2, 41 CFR101-39, CFR 102-34, and the operator's packet furnished with each vehicle. COMPUTER SECURITY: Pursuant to the Federal Information Security Management Act of 2002 (FISMA), the contractor will be required to complete a course in Computer Security Awareness Training (CSAT). This training must be completed annually by all employees including contractors, volunteers, students, and summer externs. The Contractor will be required to comply with the Federal Information Processing Standards Publication (FIPS PUB) Number 201, "Personal Identity Verification of Federal Employees and Contractors," and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification for all affected contractor and subcontractor personnel. Box 36600, Billings, Montana 59107 EVALUATION CRITERIA: The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to theGovernment, price and other factors considered. The following factors shall be used to evaluate offers for award purposes:1. PROFESSIONAL CERTIFICATION AND LICENSURE (The proposal must include copy of all professional certifications and licenses) = 35 points 2. AUDIOLOGY EXPERIENCE (The proposal must include a resume of experience and a narrative reflecting information in a sufficient detail of possessing necessary and technical skills to perform the scope of work) 30 Points3. PAST PERFORMANCE (the proposal must describe their present/previous experience in this field) =35 Points PRO-CHILDREN ACT OF 1994: The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded children's services are provided. CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI): Fingerprint checks must occur as part of the pre-employment process and must be completed before the contract providers are allowed to work. The fingerprint checks should be coordinated with the Service Unit. Please contact the Administrative Officer at the Service Unit to complete this process. A CNACI must be completed for all Indian Health Service (IHS) contractor personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, require the IHS to conduct a character and criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations will be conducted by the Blackfeet Service Unit. SPECIAL CONTRACT REQUIREMENTS: cannot serve as expert witnesses in any suit against the Federal Government. Many of the IHS patients receiving services may only speak a native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences.The Privacy Act of 1974 mandates that the Contractor maintain complete confidentiality of all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. All IHS regulations and policies applicable to these Acts shall be enforced. The Contractor shall comply with IHS facility infection control and safety procedures, practices, and standards. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees. (b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. (e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately. (f) Late submissions, modifications, revisions, and withdrawals of offers. (1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due. (2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and- (A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or (B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or (C) If this solicitation is a request for proposals, it was the only proposal received. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer. (g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. (End of provision) B.24 52.212-3 Offeror Representations and Certifications-Commercial Items (May 2014) An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision. (a) Definitions. The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals- (1) o Are, o are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency; (2) o Have, o have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; (3) o Are, o are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and (4) o Have, o have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied. (i) Taxes are considered delinquent if both of the following criteria apply: (A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted. (B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded. (ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment. (D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code). (i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126).
