- Description
- The Naval Air Warfare Center Aircraft Division Lakehurst, NJ (NAWCADLKE) intends to enter into sole source negotiations with the Raytheon Company, Garland, TX for support of the completion of the Persistent Surveillance System Cross Domain Solution (PSS CDS) security test and evaluation and installation activities and annual maintenance agreements and support for five (5) High Speed Guards (HSG). The Raytheon HSG requires maintenance and non-perpetual software licenses. The contractor specializes in the design, development, fielding, and certification and accreditation of their HSG. Raytheon is the sole manufacturer for development, maintenance, and sustainability and owns all of the associated intellectual property rights and provides no access to the source code to any reseller or other entities. These proprietary products and respective maintenance agreements can only be purchased directly through Raytheon. Under the previous contract, N68335-13-C-0163, NAVAIR procured five (5) HSG from Raytheon which included the necessary PSS CDS SABI Security Test and Evaluation of the system. Due to Government delays, Raytheon was unable to complete this testing and requires an additional six (6) months to complete the effort. Raytheon is the only source available that can provide the proprietary annual maintenance agreement necessary to complete the testing of the HSG. NAWCADLKE intends to procure these items under the authority of 10 USC 2304 (C) (1), as implemented in FAR 6.302-1. No solicitation package is available for this procurement. All responsible sources are encouraged to submit a proposal, which may be used by the Government in determining whether or not to conduct a competitive procurement. A determination by the Government not to open the requirement based upon the response to this notice is solely within the discretion of the Government.
