- THIS IS A NOTICE OF INTENT TO AWARD SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart Part 5.207(c), requiring the dissemination of information on proposed contract actions. This is a notice of intent to award a sole-source contract, and is not a request for competitive proposals. The statutory authority for this sole-source procurement is FAR 6.302-1. The National Institute for Standards and technology (NIST) intends to award a sole source, firm fixed price purchase order to Ames, Inc., located in Columbia, MD. This award is for the procurement of two (2) new Weil ground sump pumps and the repair of two (2) inoperable Weil ground sump pumps. The justification for this sole source award follows: As a result of previous competition (at time of construction of the building), Weil Pump Company, Inc.'s ground water sump pumps were installed for the purpose of removing approximately 90,000 gallons of water from around the suspension structures of Building 302, located on the NIST's Gaithersburg campus. The need for these pumps is (and will always be) an ongoing need as the building was constructed above an underground river and the use of these pumps to divert the river water will be ongoing, for the life of the building. The plumbing connections for installation of the pumps to the building, added at the time of initial building construction, is configured specifically for this manufacturer's pumps and, as such, eliminates any attempt for competition when new pumps are required for end-of-life replacement purposes. The WEIL ground water sump pumps are distributed via regional distributors; one (1) per region. The licensed distributor for this region (NE Atlantic) is AMES, Inc. Attempting competition would not be in the best interests to the Government, as the costs for awarding to a new sump pump manufacturer would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Specifically, a new source of supply would result in the Government having to undertake a complete overhaul of the current plumbing configuration - turning this need for a commercial procurement into a construction project and expending additional Government resources in the form of funding, personnel and time needed to construct a new plumbing configuration. As such, this justification is for a sole source award, to be issued to Ames, Inc.
