- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other than Full and Open Competition Agency: VA Acquisition Academy 7485 New Horizon Way Frederick, Maryland Contracting Activity:Denver Acquisition and Logistics Center 555 Corporate Circle Golden, CO 80401 1. Nature and/or description of the action being approved. The VA Academy through the Department of Veterans Affairs, Denver Acquisition and Logistics Center requests to increase the current contract ceiling for the VA Acquisition Academy Program Management and Instructional Support contract #VA798-10D-0073 on the basis of other than full and open competition with PricewaterhouseCoopers LLP (PwC). We request a 16% increase from the current contract ceiling of $30,000,000 to $36,000,000; an increase of $6,000,000. PwC will continue to provide a wide variety of Program Management and Instructional Support Services. 2. The supplies or services required to meet the agency's needs. VA Academy proposes the increase in the contract maximum to deliver the following continuation of programmatic and instructional support: SchoolPurposeAmount Acquisition Internship SchoolProgram Management and Instructional Delivery Support for 4 Warriors to Workforce and Acquisition Intern Program Cohorts$973,600 Contracting Professionals SchoolCompetencies and Context and Fellows Program Support$627,600 Program Management SchoolContinuation of 6 additional intern cohorts; based on VA-wide response and need$2,939,600 Academy EnterpriseContinuation of Program Management Support for Chancellor's Office, Program Management and Supply Chain Management School's$1,039,600 Facilities Management SchoolCompetency Assessment and Management Support of FM School$419,600 TOTAL REQUEST$6,000,000 3. Statutory authority permitting other than full and open competition. This procurement will be conducted under the authority of 41 USC 253(c)(1), as implemented by 6.302-1; Only one responsible source and no other supplies or services will satisfy agency requirements. This authority applies to PwC's continued performance 4. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Unanticipated increased VAAA growth since the inception of the initial contract has led to the current contract ceiling expected to be exceeded by $6,000,000. The contract was originally competed with the intent to provide programmatic and instructional support services for VAAA for five years. Increasing the ceiling will allow the current contract to reach its originally intended period of performance while allowing services to continue without interruption and loss of institutional knowledge. PwC has a unique position in this case since they have been performing the function for over 4 years, have developed the templates, curriculum content, methodologies, and working relationships that would take another contractor more time to develop or implement than there is time left in the contract. Complicating this unique position is VAAA's explosive and unpredictable growth in providing acquisition training to the 32,000-40,000 members of the VA Acquisition team; along with more than 17 Other Government Agencies who have utilized our award winning training. PwC is the only contractor able to continue to provide these services in a short amount of time. Competing a new contract would cause current services to halt while a contract was put in place; which would impact government-wide training to Office of Management and Budget/Office of Federal Procurement Policy mandated certification training. Additionally, a new contractor would have a learning curve before they could even begin to continue services. Hence, in order to ensure continued mission success at the VA Academy; the increase of $6,000,000 to the current ceiling amount of $30 million is required. 5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. The Government requirement for this ceiling increase will be posted on Federal Business Opportunities website after the JA is approved. This synopsis will provide notice to all potential Offerors that the government intends to execute a $6,000,000 increase to the ceiling price. 6. Determination by the Contracting Officer that anticipated cost to the Government will be fair and reasonable. The pricing was established as fair and reasonable through the original competition and is not changing. 7. Description of the market research conducted and its results or a statement of the reason market research was not conducted (see FAR Part 10). Market research was previously conducted prior to contract award VA Acquisition Academy Program Management and Instructional Support contract #VA798-10D-0073 during the solicitation process. 8. Other facts supporting the use of other than full and open competition. This authority specifically applies to the contract, and the conditions stated herein for services "deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays fulfilling the agency's' requirements. VAAA was unable to foresee the increase in VAAA growth and student demand and has become inundated with programmatic and instructional support needs. PwC performance over the life of the current contract has provided seamless content offering into our internal systems and tailored them to VA Academy's needs. At present any interruption of the aforementioned contract would cause mission interruption. The increase will cover known requirements for a one-year period of time, ending with the expiration date of the IDIQ contract. 9. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. No sources have expressed an interest in writing to date. 10. Actions to Promote Competition: As noted above in paragraph 5, a notification and justification will be posted to FBO in accordance with FAR 5.2. VAAA initiated a new competitive procurement on May 29, 2013 with SAC-Fredericksburg for an enterprise-wide Acquisition Curriculum Design/Development Contract (ACDC) to replace, in part, many of the services currently being provided under the existing PwC contract. The initial projected award date for ACDC was April 1, 2014 which would have allowed the new contract to be in place with an appropriate transition period which would have minimized disruption of services in support of VAAA. However, in the midst of moving out on ACDC, OFPP and FAI requested that the VAAA establish ACDC as a Multi-Agency Contract (MAC) to enable this contract vehicle to support all Federal agencies in their acquisition curriculum development efforts. Doing so resulted in delays in finalizing the ACDC requirement and pushed the new projected award date out to April 1, 2015. Hence, the need for this bridge action to increase the PwC ceiling to allow continued services and to align with the new projected ACDC award date. In addition, VAAA is also moving out on other enterprise wide competitive procurements to transition many of the other services (e.g., program management and instruction delivery) currently being provided under the PwC contract. Given the size and scope of the anticipated VAAA enterprise effort, the award will occur after the July 2015 expiration of the PwC Contract.
