Description
PMW 240 Distance Support requires annual maintenance, in the form of updates and technical support, as well as hard drive retention for IBM HS22V Bladecenter, Bladecenter H Chassis, and XIV Storage Updates and and support, which is available to users only if annual maintenance is purchased. It was determined that the IBM requirement or technical equivalent could be fulfilled through a GSA schedule in accordance with the procedures at FAR 8.405-1, and a synopsis of the purchase order was not required in accordance with FAR 8.404(a). However, maintenance and hardware retention for one item had to be quoted as open market in the total amount of $43,121.20 due to its unavailability through a GSA schedule. In accordance with GSA ordering guidelines and FAR 8.402(f), for administrative convenience, an ordering activity contracting officer may add items not on the GSA Schedule (Multiple Award Schedule) contracti.e.; open market itemsto a GSA Schedule Blanket Purchase Agreement (BPA) or an individual task or delivery order only if: - All applicable acquisition regulations pertaining to the purchase of the items not on the GSA Schedule contract have been followed (e.g., publicizing (FAR Part 5), competition requirements (FAR Part 6), acquisition of commercial items (FAR Part 12), contracting methods (FAR Parts 13, 14, and 15), and small business programs (FAR Part 19)); - The ordering activity contracting officer has determined the prices for the items not on the GSA Schedule contract are fair and reasonable; - The items are clearly labeled on the order as items not on the GSA Schedule contract; and - All clauses applicable to items not on the GSA Schedule contract are included in the order. Quotes were solicited from three sources in order to fulfill competition requirements and to determine price reasonableness for the open market requirements. The open market items will be labeled as such on the resulting contract, and all applicable clauses will be included.
