- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION NOAA's Acquisition & Grants Office, Western Acquisition Division, intends to negotiate, on a sole source basis, under authority of FAR 13. 501(a)(1)(i) and (ii), with Wartsila Defense to provide a new Propulsion Z Drive Control System for the NOAA Ship RONALD H. BROWN. The sole source determination is based on the National Oceanic & Atmospheric Administration's (NOAA) Office of Marine and Aviation Operations (OMAO) requirement for a new Propulsion Z Drive Control System for the NOAA ship Ronald H. Brown. NOAA requires the purchase of Z Drive Control Systems only from Wartsila Defense because many components of this existing controls system are now obsolete. This includes many printed circuit cards that are Original Equipment Manufacturer (OEM) specific. As the OEM, Wartsila Defense possesses the unique knowledge, drawings, and engineering ability to design and provide new control systems for the Z Drives. For NOAA to attempt to purchase complete integrated Z Drive control systems from another source, NOAA would need to develop a sufficient system design specification to send to potential manufacturers because the current design specs are proprietary to Wartsila. The cost of required custom engineering, testing, sea trials and ABS review and approval would add significantly to the ultimate price and likely would be an unattractive business opportunity for other firms. The ship's automation and control system is currently designed to operate with Wartsial controls outputs; therefore, introduction of another manufacturer's system could require the addition of specific data interface components, extensive re-programming to the automation system software and resubmission of the automation system changes to ABS for classification society approval. This notice of intent is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can fully meet the Government's requirements may submit substantiating documentation in writing to the identified point of contact within 15 days after publication of this synopsis. Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice.
