- The purpose of this amendment is to add the following to this combined Synopsis/Solicitation: There is no incumbent for this requirement. The Period of Performance for this requirement is 12 months from the date of award. The following typo under section “DELIVERY INTRUCTIONS” is hereby changed to read the following: CD-RW shall reference SBAHQ-14-Q-0033 Research on: The Face of Microenterprise. The offeror shall ensure to complete the following certification referenced in this combined Synopsis/Solicitation and include it as part of their quote in each CD-RW and in pdf format: 52.222-52 Exemption from Application of the Service Contract Labor Standards to Contracts for Certain Services-Certification (MAY 2014). (a) The offeror shall check the following certification: CERTIFICATION The offeror ________ does ________ does not certify that- (1) The services under the contract are offered and sold regularly to non-Governmental customers, and are provided by the offeror (or subcontractor in the case of an exempt subcontract) to the general public in substantial quantities in the course of normal business operations; (2) The contract services are furnished at prices that are, or are based on, established catalog or market prices. An "established market price" is a current price, established in the usual course of ordinary and usual trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; (3) Each service employee who will perform the services under the contract will spend only a small portion of his or her time (a monthly average of less than 20 percent of the available hours on an annualized basis, or less than 20 percent of available hours during the contract period if the contract period is less than a month) servicing the Government contract; and (4) The offeror uses the same compensation (wage and fringe benefits) plan for all service employees performing work under the contract as the offeror uses for these employees and for equivalent employees servicing commercial customers. (b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(d)(3) that the Service Contract Labor Standards statute- (1) Will not apply to this offeror, then the Service Contract Labor Standards clause in this solicitation will not be included in any resultant contract to this offeror; or (2) Will apply to this offeror, then the clause at FAR 52.222-53, Exemption from Application of the Service Contract Labor Standards to Contracts for Certain Services-Requirements, in this solicitation will not be included in any resultant contract awarded to this offer, and the offeror may be provided an opportunity to submit a new offer on that basis. (End of provision) SEARCH ON The Face of Microenterprise: Policy, Workforce, and Capital Implications SYNOPSIS/SOLICITATION: The Face of Microenterprise: Policy, Workforce, and Capital Implications This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested from this document and a written solicitation shall NOT be issued. The NAICS is 541720 and the small business size standard is $19.0 million. This is issued as a request for quote (RFQ). The solicitation number is SBAHQ-14-Q-0033 and is being issued as a Request for Quotation (RFQ). FAR 15 is not applicable to this procurement. This solicitation shall be a 100% SMALL BUSINESS SET ASIDE. This document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) FAC 2005-74 May 30, 2014. This acquisition is being conducted in accordance with FAR Subpart 13, Simplified Acquisition Procedures. In accordance to FAR Subpart 4.1102 contractors MUST be registered in System for Award Management (SAM) and DUNS number shall be required for award https://www.sam.gov/portal/public/SAM. BASIS FOR AWARD The Government intends to award a Firm Fixed Price Purchase Order. 52.212-2 -- Evaluation -- Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation if the response is advantageous to the Government, price and other factors considered. The following factors shall be used in evaluation: TECHNICAL EVALUATION CRITERIA 1. Evaluation Factors The following technical factors will be used in the evaluation of proposals. a. Quality of the technical proposal and turnaround time; its clarity and demonstrated ability to perform the research in a timely manner. Evaluation shall assess the detailed technical description of how all the required work will be accomplished. This will include evaluation of the novelty of ideas put forth, literature review, demonstrated knowledge of covered literature and subject matter, familiarity with small business research, quality and use of data sources, and soundness of methodologies proposed for analysis and their appropriateness to the overall research being conducted relevant to the Statement of Work. In addition, the project timeline will be assessed to assure that the research report is completed in a timely manner and consistent with the methodologies prescribed in the proposal. Researchers whose proposals include surveys should be mindful of the Paperwork Reduction Act and OMB clearance. For a good or excellent evaluation, the offeror must show the ability to accomplish the desired results and demonstrate the quality of work in providing services in a timely fashion. The following rating method shall be used in the evaluation of the technical approach information: Excellent - Based on the offeror's technical approach, no doubt exists that the offeror will successfully perform the required effort. The technical approach shows a complete understanding and methodology for completing the Statement of Work within the standards and workload specified. Good - Based on the offeror's technical approach, little doubt exists that the offeror will successfully perform the required effort. The technical approach shows an acceptable understanding and methodology for completing the Statement of Work within the standards and workload specified. Marginal - Based on the offeror's technical approach, some doubt exists that the offeror will successfully perform the required effort. The technical approach shows a marginal understanding and methodology for completing the Statement of Work within the standards and workload specified. Poor - Based on the offeror's technical approach, serious doubt exists that the offeror will successfully perform the required effort. The technical approach demonstrates significant deficiencies in understanding and implementing performance of the Statement of Work within the standards and workload specified. b. Researcher qualifications, experience (including past performance), if applicable and knowledge of literature in this field. The evaluation will be based on the information obtained in the proposal and, when necessary, from other references provided by the offeror. It will also look at other relevant past performance information. The evaluation will consider: (1) the qualifications of the researcher(s) relevant to the analysis being performed in the proposal and (2) knowledge and previous experience in researching the topic as stated in the Statement of Work. The Government will assess the relevant risks associated with each offeror to determine technical acceptance. Performance risks are those associated with an offeror's likelihood of success in performing the acquisition requirements as indicated by that offeror's record of past performance and knowledge and experience of the research in the fields relevant to this Statement of Work. For those offerors who have contractual prior experiences, the Government will focus on the past performance as it relates to all acquisition requirements, such as cost, schedule and performance, including standards of good workmanship; the offeror's adherence to contract schedules, including the administrative aspects of performance; the offeror's reputation for reasonable and cooperative behavior and commitment to customer satisfaction; and generally, the offeror's business-like concern for the interest of the customer. The Government will consider the number or severity of an offeror's problems, the effectiveness of corrective actions taken, the offeror's overall work record, and the age and relevance of past performance information. The following rating method shall be used in the evaluation of the technical approach information: Excellent - Based on the offeror's past performance record and/or qualifications and knowledge of the field, no doubt exists that the offeror will successfully perform the required effort of the Statement of Work. D. Cost/Price AWARD DETERMINATION: Award shall be based on best value, or the determination of whether the difference in the non-price factors is worth the difference in price. The "best value tradeoff process" permits tradeoffs among cost or price and non-cost (technical) factors and allows the Government to accept other than the lowest priced quote or other than the highest technically rated quote. The Government will select the quote that represents the best value based on the evaluation of both price and technical factors as specified. Award shall be made to that quoter whose technical/cost relationship is the most advantageous to the government. Award may be made without further information requested by the government. Quotes should be submitted initially on the most favorable terms, from a price and technical standpoint, which the contractor can offer to the government. A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are clarifications after its receipt, unless a written notice of withdrawal is received before award. Depending on technical merit, policy relevance and costs, the government reserves the right to award more than one contract under this solicitation. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (End of clause) 52.222-52 Exemption from Application of the Service Contract Labor Standards to Contracts for Certain Services-Certification (MAY 2014). (a) The offeror shall check the following certification: CERTIFICATION The offeror ________ does ________ does not certify that- (1) The services under the contract are offered and sold regularly to non-Governmental customers, and are provided by the offeror (or subcontractor in the case of an exempt subcontract) to the general public in substantial quantities in the course of normal business operations; (2) The contract services are furnished at prices that are, or are based on, established catalog or market prices. An "established catalog price" is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public. An "established market price" is a current price, established in the usual course of ordinary and usual trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; (3) Each service employee who will perform the services under the contract will spend only a small portion of his or her time (a monthly average of less than 20 percent of the available hours on an annualized basis, or less than 20 percent of available hours during the contract period if the contract period is less than a month) servicing the Government contract; and (4) The offeror uses the same compensation (wage and fringe benefits) plan for all service employees performing work under the contract as the offeror uses for these employees and for equivalent employees servicing commercial customers. (b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(d)(3) that the Service Contract Labor Standards statute- (1) Will not apply to this offeror, then the Service Contract Labor Standards clause in this solicitation will not be included in any resultant contract to this offeror; or (2) Will apply to this offeror, then the clause at FAR 52.222-53, Exemption from Application of the Service Contract Labor Standards to Contracts for Certain Services-Requirements, in this solicitation will not be included in any resultant contract awarded to this offer, and the offeror may be provided an opportunity to submit a new offer on that basis. (c) If the offeror does not certify to the conditions in paragraph (a) of this provision- (1) The clause of this solicitation at 52.222-53, Exemption from Application of the Service Contract Labor Standards to Contracts for Certain Services-Requirements, will not be included in any resultant contract to this offeror; and (2) The offeror shall notify the Contracting Officer as soon as possible if the Contracting Officer did not attach a Service Contract Labor Standards wage determination to the solicitation. (d) The Contracting Officer may not make an award to the offeror, if the offeror fails to execute the certification in paragraph (a) of this provision or to contact the Contracting Officer as required in paragraph (c) of this provision.
