The Government reserves the right to make award to the vendor whose offer conforming to this RFQ represents the overall "Best Value" in terms of the professional qualifications established for the particular personal services being acquired and the Government's estimate of reasonable rates, fees, or other costs (see Evaluation section below). Offerors may use another format for submission of quotes. However, all quotes must contain the minimum information required as listed below. Performance-Based Work Statement (PWS) EVALUATION OF OFFERS: 52.212-2 -- Evaluation -- Commercial Items. Evaluation -- Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1-Price 2-Technical Capability (Requirements of PWS section 4 met or exceeded) Technical capability is significantly more important than cost or price (See below addendum to 52.212-2 for further details). (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) ADDENDUM TO FAR 52.212-2, Evaluation - Commercial Items Evaluation of offers will be conducted IAW DFARS 237.104(b)(ii)(F), "The contracting officer shall provide the qualifications of individuals responding to the notice to the commander of the facility for evaluation and ranking in accordance with agency procedures. Individuals must be considered solely on the basis of the professional qualifications established for the particular personal services being acquired and the Government's estimate of reasonable rates, fees, or other costs. The commander of the facility shall provide the contracting officer with rationale for the ranking of individuals, consistent with the required qualifications."
