Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $100,000 (See FAR 13.106-1) Date: May 15, 2014 PR Number: 0040150639 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost): There is an urgent need for six inch main water line repair due to underground leak on Visitor center road shoulder required, involving the need for heavy construction equipment and sub-surface pipe repair expertise. Estimated anticipated cost approximately $16,000. 2. Sole Source Justification rationale (Check one and explain below): ______Only one responsible source. X Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. Underground 6-inch water main leak had reached road surface and is becoming more forceful after initial observation. Immediate action is required to prevent potential major damage to Federal and County roads and assets. It appeared imminent that the leak could only become more severe at any moment. Lack of water in the event of a larger leak or rupture would cause a forced closure of NPS and County parks which could damage roads, shoulders, park lot, lawns, plants and landscape and cause immediate loss of revenues. Public sanitation would also be affected and loss of fire protection to buildings. We are in a high risk fire danger area. Water resources are being wasted and the area is in a severe drought condition. The Contractor contacted has done similar work at the park in the past and has the resources to effect repairs in a very short repair time frame with ability to reduce mobilization time and cost. The County imposed a repair time limit of 2 days maximum, coinciding with their only scheduled closure in the month, in order to prevent major impacts to their operations, revenues and the public. This repair event is an emergency and timing is critical. _______Other: ________________________________________________________________________ 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: Immediate repair required due to nature of emergency and the potential of imminent major damage to NPS and County assets and major disruption to operations and public services, health and safety. Also, there is a potential of human injury or death in the case of total line failure due to water pressure in this size of line. Market research was conducted and the contractor selected has done similar work at the park in the past and has the resources to effect repairs in a very short repair time frame with ability to reduce mobilization time and cost. Their previous work was very good and the pricing was fair and reasonable. 4. If this is a determination of sole source, the Contracting Officer certifies: a.Only one source is available, or urgent and compelling circumstances exist. b.The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a). /s/ Peter Amerling, Project Officer /s/ Joelle M.
