INL Senior Criminal Justice Advisor Cotonou, Benin Issuance Date: 06/03/2014 Closing Date: 06/17/2014 SOLICITATION NUMBER: PSC-14-020-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. HOW TO APPLY Offeror's proposals shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. POSITION TITLE: INL Senior Criminal Justice Advisor 6. MARKET VALUE: $66,067 - $119,737 (FS-03/02 Equivalent) 7. PERIOD OF PERFORMANCE: One year from date of award and four option years 8. PLACE OF PERFORMANCE: Cotonou, Benin 9. JOB DESCRIPTION: See below GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT AND RESPONSIBILITIES OF THE CONTRACTOR: Background The Bureau of International Narcotics and Law Enforcement Affairs (INL) is part of the Under Secretariat for Civilian Security, Democracy, and Human Rights (J) within the U.S. Department of State (DOS). INL's mission is to minimize the impact of international crime and illegal drugs on the United States and its citizens through effective foreign assistance and global cooperation. INL's Office of Africa and the Middle East Programs (AME) develops and manages criminal justice sector reform programs and contributes to policy formation on civilian security issues in both regions. INL/AME personnel and INL personnel in-country administer U.S. government assistance under the West Africa Cooperative Security Initiative (WACSI) to enhance the criminal justice sectors of Benin and other countries in West Africa. The goal of WACSI is to create an inhospitable operating environment for transnational organized crime and drug traffickers. The incumbent's objective is to work regionally and bilaterally to support the Beninese government and other West African institutions and governments in the fight against transnational crime and drug trafficking. The incumbent will reside in Cotonou and travel and work primarily in three to five countries in West Africa, as circumstances dictate and allow. Purpose: The purpose of this Personal Services Contract is to fill the new position of Senior Criminal Justice Advisor (SCJA). The SCJA will provide the specialized justice expertise for all aspects of programs in Benin and other West African countries in which WACSI programs are being implemented. The incumbent will also provide internal control and accountability for the delivery of equipment, technical assistance, training, and other assistance through WACSI. The SCJA will be the subject matter expert in all areas of Rule of Law and criminal justice programs; he/she will provide significant input to the development of WACSI programs and designing its means of implementation, as well as providing expertise in evaluating the success of such programs through monitoring their implementation and results. Relationship: The SCJA will report to the Deputy Chief of Mission (DCM), and will send reports simultaneously to the DCM and the INL/AME WACSI program officer(s) in Washington, DC. The SCJA will also liaise with actors in the region working to combat transnational crime and drug trafficking. These actors include U.S. government officials, host government contacts, civil society organizations, academic institutions, and/or international organizations or commissions. Specific activities will frequently originate from these liaison activities. The SCJA will consult with INL/AME to manage programs to produce results. The SCJA will exercise independent judgment to develop new and improved methods to analyze and review INL programs throughout the West Africa region, noting new and unforeseen gaps and opportunities as circumstances evolve. Duties and Responsibilities: Substantive 1. Provide recommendation for effective WACSI criminal justice sector programs, including in areas such as prosecutorial reform, transnational organized crime, rule of law, counternarcotics, law enforcement, anti-corruption, anti-money laundering, and countering the financing of terrorism, as appropriate. The JPSC will draw on subject matter expertise in criminal justice sector reform and program management involving U.S. government assistance in developing countries. The incumbent will also be responsible for the management of these programs. 2. Advise U.S. embassies within WACSI states and INL/AME on criminal justice sector developments and opportunities in the in subject areas including, but not limited to, those enumerated in subpart 1, above.. Identify potential areas of development for future criminal justice sector programs that will fulfill INL goals and objectives. Utilize criminal justice subject matter expertise and experience to ensure that the U.S. government is fully informed of the capabilities, capacity, performance, and opportunities with regard to all elements of participating WACSI states' criminal justice sectors. 3. Advise respective embassies and INL/AME on the performance of host government agencies and implementing partners operating in conjunction with INL assets and resources. Evaluate progress towards results and recommend program improvements. 4. Engage with host government officials to help them determine how best to develop their criminal justice sector institutions to contribute to a more just society. Generate support for and actively advance U.S. policy objectives with key stakeholders, including host government officials, civil society, the media, and other private sector leaders. 5. Maintain necessary professional relationships with implementers, host government agencies, international organizations and commissions, civil society actors, and other important partners in the fight against transnational crime and drug trafficking. Act as liaison and subject matter expert between these entities and other components of the U.S. Mission(s). 6. Liaise with and assist implementers, as well as potential implementers, to develop results-oriented proposals to advance WACSI while ensuring that any commitments of USG funds are made in keeping with Federal law and State Department policy. 7. Assist in the preparation of such reporting as the annual budget request for International Narcotics, Crime and Law Enforcement (INCLE) funds and the Mission Resource Requests. Coordinate annual reporting requirements for INL (e.g., the INCSR parts I and II, the End-Use Monitoring Report, etc). Prepare program documentation and procurement requirements for assistance projects. Help prepare and ensure quality of regular reporting, and create monthly status reports for INL/AME. 8. Brief Department, Congressional, and other international dignitaries orally and in writing on INL programs in host countries. Prepare documents for presentation to the U.S. Congress, or audit entities. Develop appropriate itineraries and reserve accommodations for official travelers, as necessary. 9. Ensure that each U.S. Embassy involved in WACSI programming is effective in channeling and coordinating INL assistance. 10. Establish and maintain appropriate internal management control systems. Ensure that INL programs are not subject to waste, fraud, or mismanagement. Help manage and monitor the use of all U.S.-provided commodities intended for justice sector purposes. 11. Provide analysis and guidance in project budget preparation as well as program planning. 12. Conduct or commission field surveys, evaluations, and special studies, as directed. 13. Maintain security awareness and properly handle classified and controlled items and information. 14. Supervise locally employed staff when INL and post determine such additional staff is necessary. 15. PSC Acquisition Requirements and Duties a. Duties The contractor shall assist in the full range of activities required to identify, acquire and deploy services and commodities necessary for project implementation. These activities may include: i. Development/identification of project services and commodity requirements including discussions with host nation counterpart personnel, ii. Conduct of market research to determine potential sources of supplies/services, iii. Contact with other USG agencies with similar requirements, iv. Acquisition planning, v. Drafting statements of work/specifications and evaluation criteria for use in solicitations, vi. Development of independent government estimates of the cost/price of project commodities and services, vii. Perform the duties of Contracting Officer's Representative (COR) where necessary, viii. Participate as a member of Technical Evaluation Panels established to review and evaluate potential contractors' proposals in response to formal solicitations; and ix. Successfully complete the Department of State's on-line course "How To Be a Contracting Officer's Representative (PA-178) within 120 days of arrival at post and provide a copy of the certificate of completion to the INL/AME Program Officer and the Contracting Office (INL/RM/MS), whether or not the contractor is expected to be formally designated as a COR. b. Ethical Requirements In performance of this contract, the contractor shall be subject to the ethics rules applicable to Department of State employees under 5 CFR Part 2635 (Standards of ethical conduct for employees of the Executive Branch), 2 FAM 700 (Ethics), and 3 FAM 4120 (Employee Responsibilities Abroad) and 4170 (Official Clearance of Speaking, Writing and Teaching). Contractor shall also be subject to 5 CFR Part 2637 (regulations concerning post employment conflicts of interest). The contractor must maintain an Ethics Clearance during the performance of this contract. c. Conditions for Contracting Prior to Receipt of Ethics Clearance The Contractor may commence work prior to the completion of the Ethics Clearance. The Contractor shall not perform Contracting Officer Representative functions until such time as clearance is received. Further, if Contractor does not obtain Ethics Clearance within 30 days of commencing work, this contract may be terminated in accordance with paragraph (a)(2) of General Provision 16 of this contract. 16. Other duties, as required. Minimum Requirements: 1. U.S. citizenship, able to obtain and maintain DOS Secret security and medical clearances. 2. Two years' experience working on criminal justice issues or working within the criminal justice system. 3. Three years' experience working within the U.S. government in a foreign affairs role, within an international organization or equivalent. 4. Five years experience in program design/execution, program management, monitoring and evaluation on assistance programs or international development. 5. Five years of professional experience in a developing country, preferably in West Africa. 6. Graduate degree from an accredited institution (preferably in the areas of law, business management, international development, international affairs, political science, public administration, or a related field) or equivalent in practical experience in law enforcement, rule of law or justice sector reform. 7. Demonstrated experience in drafting complex, analytical briefing papers, memoranda, letters, and reports for review and/or signature by senior-level U.S. government officials or equivalent. 8. Demonstrated experience in working with international development programs, including drafting related reports/documents, annual budgets, and strategic plan submissions. 9. Superior negotiation, interpersonal and managerial skills. 10. Excellent oral and written English communication skills. 11. Excellent oral and written French communication skills, at the FSI 3/3 equivalent level. 12. Demonstrated experience in planning, strategizing, implementing and reporting on projects, including familiarity with basic requirements and mechanisms for contract management and procurement. 13. Working-level proficiency in Microsoft Office Suite. 14. Proven ability to complete the FSI Contracting Officer's Representative (COR) course within the first 120 days of assignment successfully. Preferred Knowledge and Skills: 1. Substantive knowledge of and experience within African of rule of law or law enforcement programs. Experience in civil code systems is highly valued. 2. Previous experience managing U.S. government assistance programs. 3. Previous experience in West Africa. Evaluation Factors: Factor 1 Program Management (30%) Demonstrated experience in program management, especially in international programs involving multiple agencies that include foreign government entities; to include experience involving analytical, planning, management, advisory, operational, or evaluative duties. Factor 2 International Experience (15%) Demonstrated experience managing programs in foreign, post-conflict environments; to include ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, and show good judgment in challenging security situations. Factor 3 Interpersonal Relations (15%) Demonstrated experience in conducting meetings and discussions that justify, defend, negotiate, overcome resistance or settle highly significant or controversial issues; to include experience coordinating and/or integrating the work of participating groups with conflicting or undefined priorities, requiring accomplishment of major compromises in the project goals, techniques and methodologies prior to substantial progress. Factor 4 Written Communication (20%) Demonstrated independent experience in preparing and writing reports, audits, memoranda, etc., in English and French, in a subject area related to the duties of the position; to include reports and decision papers requiring independent analysis and having a significant impact in the program area on an international level. Factor 5 Past Performance (20%) Evaluation of applicant's ability to perform under the same or similar contracts. In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. Pre-Award Ethical Responsibilities of PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. VETERAN'S PREFERANCE Veteran's Preference is not applicable to this position.
