DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition FAR 6.302 1.Contracting Activity: The agency responsible for this acquisition is: The Department of Veterans Affairs, VISN 19, VA Salt Lake City Health Care System (VASLCHCS), 500 Foothill Drive, Salt Lake City, UT 84148. The Department of Veteran Affairs proposes to enter into a contract on the basis of other than full and open competition for the Brand Name Kaypentax Digital Video Capture. The RFQ number is VA259-14-Q-0502. 2.Nature and/or Description of the Action Being Processed: This is a new procurement and the contract contemplated will be firm-fixed-price sole source procurement for: HD-Digital Video Capture V3 #9310HD - 1 each Stroboscope Light Source #9400 - 1 each Camera, HD #9214HD - 1 each Zoom Lens 22-37mm #9118B - 1 each Rigid Endoscope #9106 - 1 each Printer, Color #9264C - 1 each Compact Cart #80225-2 - 1 each Monitor Mounting Sys #80228 - 1 each FASU Set Up & Training #9198 - 1 each EPK Video Processor #EPK-1000 - 1 each Nasolaryngoscope #VNL-1190STK - 1 each 3.Description of Supplies/Services Required to Meet the Agency's Needs: The proposed total contract price is [REDACTED]. The VA Salt Lake City Health Care System (VASLCHCS) currently uses a visual eye procedure to diagnose patients. The Digital Video Capture V3 removes the human eye and creates a new diagnoses process using Video. This process is more accurate and will enhance our ability to treat our veterans. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c), as implemented by FAR 6.302. Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1(c) Brand Name; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The VASLCHCS currently uses the Kaypentax Brand system in several departments for diagnostics, this system will be in addition to what is currently installed at this facility. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: All efforts are being made to locate sources for this system outside of the manufacturer. Solicitation will be issued on FBO for brand name only items. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Determination will be made at time of award. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The government currently has FSS scheduled contracts for Kaypentax systems. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: The VASLCHCS prefers to stay with Kaypentax as we already use their diagnostics products in several departments. Furthermore, it would not be in the government's best interest to purchase items from another manufacturer as using another system would increase costs for updates and maintenance. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Will post to FBO. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Using another manufacturers system would increase costs for updates and maintenance as we currently maintain contracts with Kaypentax for other diagnostics equipment. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
