- THIS IS NOT A REQUEST FOR BID - PLANS AND SPECIFICATIONS ARE NOT AVAILABLE. THIS NOTICE IS BEING ISSUED TO DETERMINE IF THERE IS SUFFICIENT INTEREST FROM QUALIFIED PRIME CONTRACTORS who are Small Businesses, HUBZone small businesses, Woman owned small business concerns, 8(a) small businesses, or Service disabled veteran-owned small businesses and who intend to submit a bid for this solicitation to allow for a set-aside in one of these programs MUST submit the following by e-mail to CFLAcquisitions@dot.gov or by telefax to 720-963-3360 (Attn: Craig Holsopple) for receipt by close of business (2 p.m. local Denver time) on June 9, 2014: (1) A positive statement of your intention to submit a bid for this solicitation as a Prime Contractor; (2) A copy of the letter from SBA stating date of HUBZone small business certification or acceptance to the 8(a) small business program. In the case of a Service Disabled Veteran Owned Small Business Concern, you must provide proof of eligibility (DD form 214 or a letter of adjudication from the Veterans Administration). This information must be provided in order to determine eligibility - DO NOT SEND COPIES OF YOUR CCR PROFILE; (3) Letter from bonding agent stating your firm's capability to bond for a single project of $350 million, and your firm's aggregate bonding capacity; and (4) Provide a list of bridge construction projects of equal or greater value in which you performed CMGC (as the construction manager and general contractor) as a construction manager (CM) during the design/pre-construction phase and as the general contractor (GC) during construction. Design experience should include design milestone reviews and providing construction cost estimates throughout the development of design. Design experience must also include assisting the designers with cost estimates and providing constructability recommendations (construction methods and schedule) to maximize the cost efficiency and construction feasibility of the project. Upon completion of design, FHWA can exercise the contract options and award the construction portion of the contract based on a fair and reasonable negotiated price. Construction experience should include work in major new bridge construction, limited construction access due to environmental constraints, multiple partner coordination, major new road construction, and maintaining traffic flow during construction. State whether your firm was the prime contract or subcontractor on the project. DO NOT SEND INFORMATION ON PROJECTS THAT DO NOT INCLUDE THE ABOVE WORK. The size of a small business firm includes all parents, subsidiaries, affiliates, etc. Refer to the Code of Federal Regulations 13 CFR 121.103 for information on how the SBA determines affiliation and 13 CFR 121.108 regarding the penalties for misrepresentation of size status. This requirement may be met by expending at least 50% of the cost of the contract incurred for personnel on its employees or it may subcontract at least 35% of the cost of the contract performance incurred for personnel to one or more qualified HUBZone SBCs. A qualified HUBZone SBC prime contractor may not, however, subcontract more than 50% of the cost of the contract incurred for personnel to non-qualified HUBZone SBCs. PROJECT DETAILS: ND Charging Eagle Bay Bridge Project The Central Federal Lands Highway Division (CFLHD) currently requires a Construction Manager/General Contractor contract to assist in the development and construction of the Charging Eagle Bay Bridge Project. The Charging Eagle Bay Bridge Project (Project) is located on the Fort Berthold Reservation in North Dakota. The future facilities are under the ownership of the Three Affiliated Tribes of the Fort Berthold Indian Reservation (also known as the MHA Nation). The Three Affiliated Tribes has secured CFLHD as their Owner's Representative to provide planning, engineering and construction project delivery services, peer exchange, and other related technical support services for the Project. CFLHD intends to engage the services of a qualified A&E designer to complement the prime CMGC contractor. The Charging Eagle Bay Bridge and associated new roads will connect to State Highway 22 on the North side and State Highway 8 on the South side. The overall project length is approximately 28 miles and includes a long span bridge across the Little Missouri River arm of Lake Sakakawea. The bridge crossing is estimated to be approximately 0.85 miles. This effort will entail significant and comprehensive NEPA and permitting analysis, high level engineering principles and practices, fast paced innovative delivery practices, within the context of a team comprised of Tribal, Federal, and Private entities. The primary objective of the proposed contract is to construct the project using the Construction Manager/General Contractor (CM/GC) accelerated delivery method. The CFLHD proposes to utilize the Construction Manager/General Contractor (CM/GC) delivery method to realize the many benefits promoted through the Every Day Counts initiative. The many challenges and significant cost expected with the Charging Eagle Bay Bridge project make it a prime candidate for taking advantage of the input and experience of the builder early in the design process, leading to faster and more cost effective project delivery. This is a complicated project that will require a very experienced highway contractor due to the following issues: • Very limited construction site; • Substantial subsurface and surface water; • Sensitive environmental area; • Potential short construction seasons; • Multiple agency coordination with the Federal Highway Administration, Indian Tribes, private entities and other federal resource agencies. Although accelerated project delivery is one of the expected benefits of this delivery method, it is the cost reduction, cost containment and cost certainty advantages that make CM/CG the most attractive procurement option for this project. As a result of early contractor involvement in design, the major elements of cost reduction with CM/GC are: • Innovation incorporated based on the contractor's experience; • Design details and project sequencing tailored to the contractor's means and methods strengths; • Incorporation of the most innovative and cost effective materials and components as dictated by market prices and evolving technologies; • Less design cost due to reduction in detail; • Early reduction in risk contingencies through collaboration and negotiation; • Reduction of bid risk, including material cost speculation and design/specification interpretations; and • Elimination of traditional claims related to design documents or specification language. Contract award is anticipated by September or October 2014. The estimated period of performance would consist of an immediate notice to proceed and a fixed completion expected to be around January 1, 2017. This is an aggressive delivery schedule and will require the additional skills of a qualified CM/GC firm to meet this delivery schedule. The anticipated construction contracting range for this project is between $300 million and $350 million.
