- Justification for Other Than Full and Open Competition THIS IS NOT A SOLICITATION. THIS NOTICE IS FOR INFORMATION PURPOSES ONLY. The USDA Forest Service, Fire and Aviation Management, Pacific Southwest Region (R5) intends to award a sole source procurement as set forth in Federal Acquisition Regulation wherein circumstances of the contract action deem only one responsible source and no other supplies or services provider will satisfy agency requirements. These services will be procured as a commercial item in accordance with the procedures in FAR Part 12 (Acquisition of Commercial Items) and FAR Part 13 (Simplified Acquisition Procedures). The purpose of the requirement is to establish a sole source award under FAR 6.302-1 for technological upgrades to the USDA FS Aerial Supervision Simulation System. The Simulation System is central to the Aerial Simulation Program and is critical to the effective accomplishment of this program. The USDA Forest Service, Fire and Aviation Management, Pacific Southwest Region (R5) intends to award this contract to ATC Flight Simulator Company, 12165 Branford St., Suite E, Sun Valley, CA. 91352. The ATC Flight Simulator Co. is the sole authorized provider for ATC-212HM, ATC-920M, and related hardware and software enhancements for the Federal Government. Any vendor responding to this request shall provide evidence that: 1) it is a certified 3rd party provider Of the ATC Software, 2) it has an agreement with ATC to sell ATC Simulator products and 3) it is able to provide ATC Simulator related services to the Federal Government. All responses from responsible sources will be considered. Responses must include all required evidence, as stated above, to allow this office to evaluate the possibility of the firm to submit a valid proposal. The determination to open competition based on responses received is solely within the discretion of the Government. If a solicitation is issued, no additional synopsis will be published. Responses must be submitted electronically, via e-mail, to (pjgordon@fs.fed.us), by 4:00 pm PDT on June 13, 2013.
