Description
Justification for Other than Full and Open Competition (JOFOC) This publication serves as notice of intent to procure services for the Department of Commerce (DOC), National Oceanic & Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), on a sole source basis with the URS Group, Inc., in accordance with the authority of 41 U.S.C. 253 (c)(1), One Responsible Source. Using FAR Part 13.5, ( Commercial Item Test Program ) procedures the Government intends to negotiate a contract with URS Group, Inc. for the completion of Phases 2 and 3 of Environmental Assessment (EA) applications in compliance with NEPA for six different fisheries for a total performance period of two years. NOAA Fisheries determined that additional effort will be required by URS to complete Phase 2. This additional work will address environmental issues as well as expedite completion of draft NEPA documents necessary for agency review. The scope revisions will increase the number of labor hours for gathering data, analysis, document review, and calls for additional meetings. In addition, NOAA Fisheries anticipates that additional labor hours, travel, and drafting workshops will be required by URS for at least two (2) additional science centers. Phase 3 of this project (preparing the final EA and Letter of Authorization (LOA) applications) includes the labor hours required to process agency and public review comments on the draft EAs and to prepare final EAs for agency review. This phase also includes a new subtask of preparing Marine Mammal Protection Act LOA applications for all science centers. These applications will be supported by the corresponding EA for each science center. As URS Group has already completed the majority of this project, a re-compete of the remaining work would not be feasible due to the time and money that would be required to bring in an outside vendor up-to-speed for Phase 3 of the project. For this reason, these services are determined to be non-severable, thus a modification to the existing GSA order (GS-10F-0105K) is necessary. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, any firm that believes it can meet this requirement may provide written notification to the Contract Specialist requesting a copy of the solicitation and all proposals received within thirty (30) days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The NAICS code for this requirement is 541620 and the small-business size standard is $14M of average annual receipts. All vendors doing business with the Government are required to be registered with SAM (System for Award Management). NO award can be made unless the vendor is actively registered in SAM.
