- Draft PWS This is a sources sought notice only. The purpose of this notice is to acquire knowledge about potential qualified sources that can provide the U.S. Department of Education with a Adobe Enterprise License Agreement, as well as receive feedback on the attached draft Performance Work Statement (PWS). Responses to this notice are requested to include the following: A) Company Name B) Address C) Point of Contact D) Number of Employees E) Gross annual receipts F) Previous contract(s) performing same or similar services as identified in this notice, to include contract type, overall value, Agency/Business entitiy, brief overview of services performed. G) Capability Statement that addresses the organizations qualifications and ability to perform as a prime contractor for the work described in the attached PWS. Please include a page break before addressing each PWS, as each one may have a distince end-user. Documents with cross referencing may not be received as favorable. H) Does your company operate as a GSA holder? If yes, GSA number. I) Are you a Service-Disabled Veteran Owned Business? (YES/NO) J) Are you a certified HubZone Small Business? (YES/NO) Please also address the following questions (limit to no more than 5 pages, single spaced, response submission). 1. How does the Department stay flexible, pricing included, to account for the software manufacturer's restructuring the EA prcing models? 2. As new and/or changed products are introducted into the marketplace, what is the pricing impact on the EA, if the Department wants to take advantage of these new product(s)? Does the ETLA always have to be restructured? 3. Does the ETLA allow the Government to take advantage of downward adjustment's in the market price of software licenses? How do vendors account for upward adjustments in license pricing? 4. Do you have the ability to report on multiple EA's underneath a base contract or BPA? 5. Do you have the ability to restrict downloading products not on an authorized buying list? 6. Is there an established TRUE-UP process and please indicate your company's approach (i.e. monthly, quarterly prior to the end of Period of Performance (PoP)). 7. Can you provide recommendations how the Department might align their license so that they will expire at the same time. 8. Do you have the ability to purchase of a current contract or BPA and do you operate in a particular GWAC that would support an Adobe EA? Information submitted in response to this sources sought notice is to be used for planning purposes only. This notice shall not be construed as a request for proposal. This notice does not obligate the Government to award a contract, it does not restrict the Government in its ultimate acquisition approach, nor does it obligate the Government to pay for any proposal preparation costs. No entitlement to payment of direct or indirect costs or charges by the Government will accrue as a result of a submission or of a response or use of such information. Please submit all responses by 12:00a.m., EST on 16 May 2014. Please submit all questions/comments/responses via email. The Department does not intend to post a Question and Anwser amendment to this notices. Instead, the Department intends to take those questions as items that will be utilized to strengthen the Department's RFP/Solicitation documents. Respondents may be contacted for additional information. A letter stating your interest or requesting a copy of the soliciation is NOT sufficient to determine contractor capability.
