Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (1)Agency and contracting activity (FAR 6.303 2(a)(1)) This requirement is for the 174th Civil Engineering, Hancock Field ANGB, Syracuse, NY. The contracting agency is the 174th Contracting Office, Hancock Field ANGB, Syracuse, NY. (2)Nature and/or description of the action being approved (FAR 6.303 2(a)(2)) This is for the purchase of a replacement boiler and pump for B655. (3)Supplies or services required to meet the Agency needs (including estimated value) (FAR 6.303 2(a)(3)) The contractor shall provide all personnel, tools, materials, supervision and other items necessary to include the boiler, secondary low water cutoff, pump, shipping and start-up. (4)Statutory authority (FAR 6.303 2(a)(4)) FAR 6.3.01-1 Only one responsible source and no other supplies or services will satisfy agency requirements. The purchase is for equipment associated with the use of existing equipment where compatibility is essential for integrity of results. (5)The proposed contractor's unique qualifications require use of the authority cited above (FAR 6.303 2(2)(5)) Modular Comfort Systems can provide the boiler and pump to match an already existing boiler in place. No others known in the area. (6)Description of efforts to ensure that offers are solicited from as many potential sources as practicable (FAR 6.303 2(a)(6)) Three companies were contacted in the area. Their products do not equal the quality or cost for an equal model. Boiler must be compatible with existing boiler. (7)Determination of fair and reasonable cost (FAR 6.303 2(a)(7)) Price comparison was made against a previous awarded contract as well as quotes for "or equal" items. Price is deemed fair and reasonable. (8)Market survey (FAR 6.303 2(a)(8)) Three companies were contacted for product information in the local area. (9)Other facts supporting the use of other than full and open competition (FAR 6.303 2(a)(9)) None. (10)List of sources, if any, that expressed a written interest in the acquisition (FAR 6.303 2(a)(10)) None. (11)Actions, if any, that are being taken to remove and overcome any barriers to competition before any subsequent acquisitions for the supplies or services required (FAR 6.303 2(a)(11)) None at this time. (12)Contracting Officer's certification (FAR 6.303(a)(12)) I have determined that the anticipated cost to the government will be fair and reasonable and certify that the justification is accurate and complete to the best of my knowledge and belief.
