Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION I. The Department of State (DOS) Office of Acquisition Management has requirements to provide Life Support Services to the U.S. Embassy in Tripoli, in the country of Libya. Over the past two years the services have been provided under a sole source contract that was awarded under the Authority of Sect ion 8{a) of the Small Business Act. Life Support Services are needed for an additional 90 days so a new Life Support Services contract can be awarded competitively. 2. Nature and/or description of the action being approved: The Department intends award a ninety (90) day. The contractor will provide aspects of life support services to the United States Embassy Tripoli for ninety days from approximately April 1, 2014 to June 30, 2014. 3. A description of the supplies or services required to meet the Department's needs: These services include, but are not necessarily limited to: I. Food Service 2. Housekeeping Services 3. Grounds and Lawn Maintenance 4. Pool Maintenance 4. An identification of the statutory authority permitting other than full and open competition: This justification is being made on the basis of Unusual and Compelling Urgency 41 U.S.C. 253(c)(2). Tripolii is a High Threat Post and the ability for Embassy personnel to move freely within the area are extremely limited. The services being provided under this contract are limited to life support services necessary to support DOS personnel assigned. 5. A demonstration that the proposed contractor 's unique qualifications or the nature of the acquisition requires use of the authority cited: The contractor is successfully performing at this location under a contract awarded under the authority of Section 8(a) of the Small Business Act. The contractor has since graduated from the Program which precludes the Department from making a follow on award under that Program. 6. A description of efforts made to ensure that offers arc solicited from as many potential sources as is practicable: The long term contract will synopsized, on an unrestricted basis, for a fifteen (15) day period to ensure the widest dissemination of information to interested firms. 7. A determination by the Contract ing Officer that the anticipated cost to the Government will be fair and reasonable: The pricing will be analyzed based on the h istorical costs for the services provided. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted: None. During the previous periods of performance Post had numerous construction projects on-going and only recently determined the future life support services requirements. This significant change in the requirements necessitated a change in the overall acquisition strategy and a delay in having a replacement contract awarded and did not provide for lead time necessary to conduct meaningful market research. 9. Any other facts supporting the use of other than full and open competition: None. 10. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: The long tem1 contract will synopsized, on an unrestricted basis, for a fifteen ( 15) day period to ensure the widest dissemination of infom1ation to interested firms.
