- Posted Date: April 25, 2014 Procurement Office: U.S. Environmental Protection Agency, Superfund RCRA Procurement Operations Division (3805R) 1200 Pennsylvania Avenue, NW Washington, DC 20004 Response Date: April 30, 2014 Authority: The authority and reference is FAR 6.302-1 "Only one responsible source and no other supplies or services will satisfy agency requirements." The U.S. Environmental Protection Agency?s Office of Superfund Regional Procurement Operations Division intends to award a sole source firm-fixed priced Purchase Order to purchase a maintenance agreement with ????? PANalytical for the Epsilon 5 x-ray fluorescence instrument used in support of a variety of studies conducted to inform decisions related to Air, Climate, and Energy. Examples include human exposure and air quality studies, criteria pollutant standard development and assessments, and methods evaluations. PANalytical does not authorize any third parties to perform maintenance or repair on its instruments for a variety of reasons related to maintaining the integrity of the product/instrument. PANalytical, Inc. is the company which manufactures and services this equipment. PANalytical inc. does not subcontract with any company to manufacture or service this equipment or any of the major components. No other Company is fully aware of the proprietary materials. engineering designs, and processes, which are employed in the manufacture of this equipment. NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE. Notwithstanding, any firm that believes it is capable of meeting EPA's requirement as stated herein may submit a capability statement, which if received within five (5) calendar days of the date of this announcement will be considered. Responses to this posting must be in writing and provide clear and convincing evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government.
