- SOLICITATION 1. The Office of Acquisition Management is conducting this acquisition for the renewal of the annual license fee for use and maintenance of Polk's Complete Pre-Fix File on behalf of DS/OFM/OA. 2. Nature and/or description of the action being approved. The Office of Acquisition Management (A/LM/AQM), Department of State (DoS) is processing the acquisition at the request of the Bureau of Diplomatic Security, Office of Foreign Missions, Information Management (DS/OFM/IM). This Justification and Approval (J&A) on brand name basis is for use of R.L. Polk's CPF, Complete Prefix File (aka VINA), which VIN Verification Solution that was developed by Polk for use in business and government entities in order to verify VINs, flag errors, and return descriptive vehicle information. The use of brand name is essential to the Government's requirements, for Department of State, Office of Foreign Missions information System thereby precluding consideration of the products of another company which would need system re-customization. The re-customization of OFM Information system would result in exorbitant duplicative costs for the re-configuration to allow for another vendors VIN Verification Solution to interface with our existing system which are far greater costs that exceed simply remaining with the existing vendor (Polk). 3. A description of the supplies or services required to meet the agency's needs. The Bureau of Diplomatic Security, Office of Foreign Missions TOMIS system is integrated into R.L. Polk's CPF, Complete Prefix File (aka VINA) file. This system has been a part of the integrated system and has provided service for many years. VINA is a required component of the registration process and is a standard applied by most state and local DMV authorities to validate vehicle numbers of vehicles manufactured and/or sold in the United States. Because of the sensitive nature of information derived from VIA, it must be properly maintained. No supplies are required; the contract is for the service only. 4. An identification of the statutory authority permitting other than full and open competition. 41 U.S.C. 253(c) (1), and FAR 6.302-1 are cited as the statutory authority. 5. A demonstration that the proposed contractor's unique qualification or the nature of the acquisition requires use of the authority cited. See Paragraph #3, R.L. POLK is the only provider for this service. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as it practicable. As required by FAR 5.2, a notice will be publicized to provide fair opportunity. A justifacation and Solicitation was posted on FBO.Gov for industry awareness. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. A/LM/AQM has conducted a brief informal survey on-line of providers to include considering estimated costs of re-configuration of the Office of Foreign Missions Information System to accommodate a competing vendor. It has been determined that any re-configuration costs would off-set the costs of any gains from competition. In addition the costs could be considered duplicative as cited in FAR 6.302-1(a)(ii)(A). The offered price from Polk is considered fair and reasonable based on an invoice received for another agency receiving similar service from Polk and based on past acquisition history were prices have not significantly increased over time since our beginning usage.,. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. DS/OFM/IM has researched vendors of vehicle identification number (VIN) software and R.L. Polk was identified as the only vendor that provides a standard VIN verification product that is widely used by DMV's throughout the U.S. A/LM/QM has found other possible sources, but no other source is currently configured to operate with the DS/OFM/IM information system. 9. Any other facts supporting the use of other than full and open competition. See detail in paragraphs (1) through (8) above. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. N/A. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. At this time the current IT infrastructure deployed by the DoS does not allow for any additional industry solutions. However, as DoS deployed infrastructure evolves with industry technology, further solutions will be considered competitively.
