Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: : Department of Veterans Affairs, VISN 08, VACHS Medical Center, Facility Management Service At San Juan P.R. Justification for Other Than Full and Open Competition 672-14-1-510-0055. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of replacement equipment. (Heat Exchangers for Hot Water Heaters Replacement). The action will be awarded as a new firm-fixed price purchase order. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The contractor will provide two (2) heat exchangers for QuickDraw STEAM WATER HEATERS, Model number - 60 P 5A-1S. Serial number - 0408124201. Part number - 184685-1. The contractor should include two (2) fastener flange kit, sixteen (16) bolts and sixteen (16) nuts compatible with the parts to be installed. These heat exchangers are for the Hot Water Heater that serves the patient bed tower (SBT) at VA San Juan. 4.Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-2 (b)(2) Unusual and compelling urgency. ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (x) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The objective of this acquisition is to acquire new heat exchangers replacement for the SBT Water heaters. The South bed Tower is been serviced for only one Water Heater and has lost heating efficiency. If unable to replace the units' parts, as soon as possible, will result in major facility HVAC system shut down affecting directly the patient's bed building. PVI Industries is the manufacturer that can supply with same units replacement without major system modifications. They have provided, under other contracts, air compressors system for other services. They were contacted and provided an estimate cost of $8,672.00. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Limited market research was done and was found that PVI Industries, the manufacturer, is the company who can support the replacement of the heat exchangers for the SBT Hot Water Heaters without major changes to our existing system. Technical Distributors, who is a PVI Industries distributor, provided higher cost estimate for the replacement parts. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Estimate cost $8,672.00. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to the urgent situation, limited market research was done and was found that PVI Industries can support the replacement of the heat exchangers for the SBT Hot water heaters. Only one local distributor from manufacturer was found (Technical Distributors) and provided higher cost estimate. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: The only local distributor for the required parts provided higher cost estimate, government will benefit if purchase the parts from the manufacturer.
