- Statement Of Work The purpose of this contract is to provide Shuttle Transportation Services for patients and/or employees of the Department of Veterans Affairs Medical Center Atlanta, located at 1670 Clairmont Road, Decatur, Georgia to LocationAddressDistance From Medical Center Decatur Marta Station400 Church Street Decatur, GA 300302.42 miles Decatur Clinic755 Commerce Drive Decatur, GA 300332.26 miles Henderson Mill Annex2296 Henderson Mill Road Atlanta, GA 303455.33 miles Briarcliff Baptist Church3065 Briarcliff Road Atlanta, GA 303292.71 miles Contractor shall provide shuttle vehicles capable of carrying 12-18 persons per trip, personnel, equipment, supplies, management, and provide reports to the Contracting Officer's Technical Representative as set forth under and in accordance with all terms, conditions, clauses and provisions in this solicitation. The contract period is for a base year with four (4) one year option renewals at the Government's discretion. Contractor shall provide shuttle services utilizing vehicles capable of transporting 12-18 people using the following schedules: LocationHours Excluding federal holidays# of Hours per day Decatur Marta StationMonday-Friday 6a-6p12 Decatur ClinicMonday-Friday 6a-6p12 Henderson Mill AnnexMonday-Thursday: 6a-8p14 Friday: 6a-6p Briarcliff Baptist ChurchMonday-Friday: 6a-6p12 Contractor shall provide enough vehicles to handle peak usage times and shall have at least one shuttle vehicle available and operational at all times. Contractor shuttle transportation will operate on a 15 minute schedule during peak times (6:00am-9:30am and 1:30pm-6:00pm) for all locations. During none peak times (9:30am-1:30pm) the shuttle will operate on a 30 minute schedule. The Briarcliff offsite parking location will remain on a 15 minute schedule between the hours of 6:00am and 6:00pm. Additional service locations may be added during the term of the contract and may require contract modifications. A. 10-2.NUMBER OF EMPLOYEES OR PATIENTS The Contractor must ensure that pick-ups and drop-offs are accomplished every 15 minutes between the medical center and CBOC/off-site parking destinations. The off-site parking destinations contain 99 parking spaces. The number of persons riding the shuttles throughout the day will vary. The highest concentrations will be at the beginning of the day (06:00-09:30am) and at the end of the day (1:30-6:00pm). The contractor must maintain adequate van coverage to meet the increased demand during peak times. A. 10-3 RESPONSE TIME 1.The Contractor is required to provide shuttle services every (15) minutes between pick-up points. If the contractor fails to provide the vehicle within the above prescribed time period, the VA reserves the right to obtain the services from another source and shall charge the Contractor with any resulting excess costs. The VA will be the sole judge in determining when to order services from another source. 2.The Contractor is required to provide shuttle or shuttle services at the designated time period referenced above. If the Service Provider is aware of any delay in meeting a scheduled pick-up time, the COTR shall be notified of the delay the reason for the delay and the estimated time of arrival. 3.The Contractor will provide written documentation with explanation when contract services are unavailable with signature of responsible parties. VA will issue Bill of Collections for any costs obtained from another source. Failure to pay as charged within timeframes specified in the Bill of Collections may result in deduction of costs from the next month's invoice. The COTR (after conferring with the Contracting Officer) will be the sole judge, in determining when to order service from another source. When all contract shuttles are in use and the VA requires additional vehicles, the Contractor will be contacted first and has the option to provide additional shuttle vehicles at the contract price. Appropriate transportation to meet demand will be dispatched within one-half hour from the scheduled pick-up time arranged by the VA Medical Center Atlanta. In the event the employee or patient is not picked-up as described in this solicitation, the VA Medical Center Atlanta will be allowed a late credit equal to the rate charged by Contractor in A.10-4. A.10-4 PICKUPS The Contractor shall transport employees and patients to and from the main campus and external locations previously described. The Contractor is required to have available enough operational shuttles at all times. Adherence to the route schedule is of utmost importance. The Contractor must pick up the employees or patients as near to the 15 minute scheduled pickup time as possible. If the Contractor arrives earlier than the scheduled pickup time, the driver must wait at the pickup location until the scheduled pickup time before moving to the next location. Orders, request, or changes will only be made by the Contracting Officer or COTR with the Contracting Officer's consent. Under no circumstances shall there by any deviation of any other party. In addition, Contractor shall not make any deviations in the route or time and beyond safety is not responsible for providing direction to the staff during transport to specified locations. A.10-5DRIVER'S CONDUCT The following acts are not permissible by drivers that provide services under this contract or while on VA premises. 1.Use of intoxicating liquors, narcotics or controlled substances of any kind (excluding doctor's prescriptions which do not impair driver's driving ability) while on duty or reporting for duty while under the influence of liquors, narcotics or controlled substance of any kind (excluding doctors' prescriptions which do not impair driver's driving ability.) 2. Gambling in any form. 3.Smoking and other uses of tobacco while on duty. VA Employees, Patients and or Contractor staff are prohibited from smoking on shuttles. The smell and residual smoke may cause other patients who will be riding in the transportation vehicle to become ill. 4.Carrying of pistols, firearms or concealed weapons. 5.Resorting to physical violence to settle a dispute with a VAMC employee or patient in general public while on duty. 6.Spitting in prohibited places or any other unsanitary, offensive or insensitive practices or behavior. 7.Use of loud, indecent or profane language and/or making threatening or obscene gestures toward customers or other employees. 8.Stopping for personal business, including excessive use of restroom facilities, while shuttle is occupied by a passenger. The driver shall not leave the shuttle with the key in the ignition at any time. 9.Engaging customers in a verbal confrontation in an attempt to settle a disagreement. Should a disagreement arise, the driver is to contact his dispatcher/supervisor via the radio system. Also, drivers will not engage in any religious, political or personal discussions with occupants. 10.Soliciting or accepting tips from customers, companions or others at any time. Drivers will display professional manners at all times. Rude or obscene behavior or language will not be accepted. Aggressive driving will not be tolerated. Nor will drivers be expected to tolerate the same from the passengers. A.1O-6COMMUNICATION SYSTEM: The Contractor's Communication System shall consist of: 1.Telephone System 2.The Contractor shall make available sufficient telephone capacity to ensure immediate communication access between Atlanta VA Medical Center and the Contractor's facility for the purposes of canceling trip requests as well as handling other emergencies. 3.The Contractor shall have telephone coverage to accept calls from Atlanta VA Medical Center during the hours of 5:30AM to 8:00PM. 4.The Contractor shall ensure the availability of GPS tracking devices, mobile radio and/or cellular telephone communication with all shuttles providing transportation service at all times. If the Contractor's place of business is located beyond the local telephone call zone of the Atlanta VA Medical Center, the Contractor will accept telephone orders for service on a collect basis or provide a toll-free number. A.1O-7.SPECIAL REQUIREMENTS: 1.When conditions, neither foreseeable and/or controllable by the Contractor occur, such as but not limited to severe storms, flooding, hazardous road and travel conditions, time and distance requirements shall be considered secondary to safety precautions. Delays or exceptions to the required quality of services will be reported to the COTR or AOD. The COTR will make a determination as to whether such delays in service will be excused. 2.Contractor shall immediately report all incidents and accidents to the VA Police dispatcher and other appropriate officials, (i.e., 911), including those where there is no apparent injury to the patient, which occurs while transporting VA beneficiaries. A written report from the driver documenting the facts of the incident/accident must be provided to the VA Medical Center within 24 hours of the occurrence. The written report will include the names, addresses, and telephone numbers of any witnesses as well as any applicable Police Reports. Any accident involving major damage, serious personal injury or loss of life shall be reported to the COTR immediately. Records shall be kept for three (3) years for each accident a shuttle is involved in, including the repair work required to return the shuttle to service. A10-8SERVICE DISRUPTION: The Contractor shall report to the COTR or AOD any and all shuttle breakdowns (with vehicle number) or other problems, which may cause service disruptions immediately. When a breakdown occurs, it is the responsibility of the Contractor to provide back-up shuttles to minimize any delay or inconvenience to the customer(s). Contractor shall provide backup vehicles to minimize any delay in transporting the employees or patients. The Contractor shall immediately notify the Atlanta VA Medical Center's Police Department of all vehicular accidents including those that involves major damage, serious personal injury, or loss of life. The Contractor shall maintain a record of each vehicular accident for three (3) years including the repair work that is required to return vehicle to service. The Contractor shall immediately notify the COTR of any conditions that occur, which are not reasonable and/or controllable by the Contractor (i.e. inclement weather, road hazards, etc.) and could result in a delay of shuttle service. The COTR shall make a determination as to whether such delays in service are excusable. A.l0-9PROVISION OF SERVICES: 1.The Contractor shall be required to maintain 95% on-time performance on a daily basis. Trips will be considered "on-time" as long as they arrive at the destination on or before the scheduled arrival time. 2.Drivers shall wear appropriate attire with a picture identification badge that clearly identifies the company they work for and the contract employee's name. 3.Driver shall ensure the employees or patients are seated in an approved seat prior to transportation actually beginning from a location. No one will sit on the floor or stand in the vehicle. 4.Contractor shall immediately notify the COTR of any vehicle breakdowns or other problems that can result in service disruption. 5.Contractor's performance shall be in conformance with the contract and all applicable Federal, state, and local laws to include Department of Transportation, 49 CFR, Parts 27, 37, 38, 571 and VA Standards. All regulations of the State Public Service Commission (PSC) (of where the Contractor's facility is located) governing the control, operation of and licensing of the transportation contractor are incorporated herein by reference. All records submitted to and/or compiled by the Contractor regarding vehicle inspections, safety, maintenance records, and manifests, etc. may be reviewed prior to awarding a contract and periodically throughout the terra of contract. 6.If the vehicle is not equipped with an automatic step, the driver will exit the vehicle and place a step at the door to assist passengers loading and unloading the vehicle. A.10-10.DRIVERS LIST: The Contractor shall provide the COTR a list of all drivers, utilized for this contract by the fourth day of each month. The Contractor shall ensure that all drivers providing services under this contract will have less than five (5) current points on their driver's license, none of which were assessed for "Reckless Driving." VA Medical Center Atlanta reserves the right to order the removal from service under this contract, any driver who violates the provisions of this section. Contractor shall provide a copy of the state driver's license as supporting documentation. A.l0-11CERTIFICATION OF INSURANCE COVERAGE: Before award of the contract, the Contractor shall furnish to the Contracting Officer a Certificate of Insurance (see FAR Clause 52.228-10) containing an endorsement to the effect that cancellation or any material change in the policies which adversely affect the interest of the Government, shall not be effective unless a thirty (30) day written notice of cancellation or change is furnished to the COTR. The term "will endeavor" is not acceptable as issued by Insurance Carriers. A.lO-12.CONTRACTOR EQUIPMENT AND VEHICLES: The Government reserves the right to inspect Contractor equipment and vehicles, or require documentation of compliance with contract specifications. Such an inspection if conducted does not constitute a warranty by the Government that the Contractor's vehicles and equipment are properly maintained. The Government reserves the right to restrict the Contractor's use of equipment and vehicles which are in need of repair, unclean, unsafe, damaged on the interior or exterior body, and are not in compliance with contract specifications. The restriction of such equipment and vehicles shall not relieve the Contractor from providing all required services as defined herein. The Contractor shall transport beneficiaries in vehicles (for the required purpose) that meet the specifications identified herein. Vehicles and equipment used in performance of this contract shall be as follows: a.All vehicles shall meet current applicable Federal, State and local specifications and regulations including, but not limited to, licensing, registration, insurance coverage and safety standards. Licensing by the State of Georgia is required. Vehicles shall also meet any city or county requirements as mandated by these agencies. b.Vehicles shall be clean and in good repair at all times during the performance of this contract. All vehicles shall be equipped with a first aid kit and a warning triangle. c.Vehicles shall undergo continual preventive maintenance as per manufacturer's recommendation. d.All vehicles shall be equipped with a cellular phone and GPS that shall be operational at all times during contract performance. Vehicles shall meet or exceed all applicable Federal, State and local regulations in regard to chauffeuring paying clients. This shall include all Department of Transportation requirements. The shuttle vehicles and their equipment and supplies must be of the quality, model and condition to assure high quality transportation and shall meet the minimum standards for maintenance, equipment and staffing of all sedans operated. Shuttles must have adequate straps and seat belts necessary to secure employees or patients. The Contractor must have records of preventive maintenance of all sedans being used for service to the VA. Shuttles and maintenance records will be made available to the VA for quarterly inspections or whenever the COTR feels such inspections are needed. A.10-13.VEHICLE SPECIFICATIONS All shuttle vehicles under the terms and conditions of this contract shall be licensed and meet the minimum vehicle requirements as mandated by the Department of Transportation in the State of which the vehicle is operated (Georgia). All shuttles must have the following: 1.Contractor shall provide a list of all shuttles utilized on this contract to the COTR. The list shall include shuttle vehicle identification numbers and insurance certificates prior to providing service. 2.Contractor shall submit vehicle list to the COTR by the fourth day of every month. 3.The shuttle vehicles under the terms and conditions of this contract shall be licensed and meet the minimum vehicle requirements as mandated by the Department of Transportation in the State which the vehicle is based (Georgia). 4.Vehicles shall have a functioning speedometer which indicates speed in miles per hour (MPH) and a functioning odometer which indicates distance correctly in tenths of a mile. 5.Sedans shall be equipped with operational heating and air conditioning systems. Contractor shall not operate a shuttle for beneficiary pick-up if the AC system is inoperable and the temperature is forecasted to exceed 70 degrees Fahrenheit. Shuttles shall not he used for transportation service until AC system or heating has been repaired. Shuttle vehicles shall not have grime, oil or other substances, cracks, breaks, dents, and damaged point that noticeably detracts from the overall appearance of the shuttle vehicle. 6.Shuttles shall have all body molding in place, or if removed, holes shall he filled and painted. 7.Shuttles shall have passenger compartments that are clean and empty. 8.Shuttles shall not have torn upholstery or floor coverings, damaged or broken seats, sharp objects or edges that are protruding, or insects and vermin. 9.Shuttles shall have windows and doors, which can be opened and closed in accordance with manufacturer standards. 10.Shuttles shall meet all safety and mechanical standards established by Federal, State and local statutes and regulations. 11.Shuttles shall have flares and reflective emergency cones or similar devices in the event of a breakdown. A.1O-14.VEHICLE INSPECTIONS 1.The COTR shall inspect all vehicles that are to be utilized in the performance of this contract. These inspections shall be conducted: a. Prior to contract start. b. At the beginning of each contract period. c. Before each initial use of a vehicle that is added to the monthly list d. Quarterly throughout the life of the contract. e. Whenever the COTR determines an inspection is warranted. f. Before a vehicle that has been out for repairs is returned to the fleet. 2.Contractor shall not use any vehicles for this contract that do not pass inspection. 3.COTR shall contact the Contractor to coordinate the date, time, and location for inspections. A 10-15.INSPECTION PRIOR TO AWARD: The right is reserved to thoroughly inspect and investigate the establishment, facilities business reputation and other qualifications of any offeror and to reject any offer, irrespective of price. VA Medical Center Atlanta reserves the right to inspect all shuttle vehicles prior to award. If any equipment is added after inspection, subsequent to award of contract, it shall be inspected and approved by the Contracting Officer and/or Contracting Officer Technical Representative before being placed in use under this contract. The Government reserves the right to inspect any hired shuttle used to provide transportation services under this contract and reject equipment, without advance notification which is found to be in a condition or equipped in a manner which does not comply with contractual provisions. Such suspensions will be effective at the time of arrival of such equipment, or at the time the COTR notifies the contractor that deficiencies have been reported. A.1O-16.COMPLAINTS HANDLING: The COTR will monitor the service provided. The Contractor shall cooperate with the COTR in providing information and answering questions in a timely manner when requested. The Contractor shall refer complaints received directly from the customer(s) to the COTR. All complaints received by the COTR and forwarded to the Contractor shall be investigated promptly. After investigation and disposition, the Contractor shall respond to the COTR within five (5) working days after receipt by the Contractor. A.IO-17.CHANGES TO CONTRACT 1.The Contracting Officer is responsible for the administration of this contract. The Contracting Officer is the only individual authorized, to the extent indicated in this contract, to take action on behalf of the Government, which may result in changes in the contract terms, to include deviations from the statement of work, details, and performance schedules. 2.Communications pertaining to contractual matters shall be addressed to the Contracting Officer. No changes in or deviation from the scope of work shall be effected without a written modification to the contract executed by the Contracting Officer. No oral statements of any person whom so ever will in any matter or degree modify or otherwise affect the terms associated with this contract. 3.The Contracting Officer does, however, reserve the right to designate one or more representatives to act in a capacity of furnishing technical guidance and advice, or generally supervise the work to be performed under this contract. A copy of the Contracting Officer Technical Representative (COTR) designation shall be furnished to the Service Provider. A.10-18.QUALITY CONTROL PROGRAM: 1. PURPOSE This Quality Assurance Surveillance Plan (QASP) provides a systematic method to evaluate performance for the stated contract. This QASP explains the following: oWhat will be monitored. oHow monitoring will take place. oWho will conduct the monitoring. oHow monitoring efforts and results will be documented. This QASP does not detail how the contractor accomplishes the work. Rather, the QASP is created with the premise that the contractor is responsible for management and quality control actions to meet the terms of the contract. It is the Government's responsibility to be objective, fair, and consistent in evaluating performance. This QASP is a "living document" and the Government may review and revise it on a regular basis. However, the Government shall coordinate changes with the contractor. Copies of the original QASP and revisions shall be provided to the contractor and Government officials implementing surveillance activities. 2. GOVERNMENT ROLES AND RESPONSIBILITIES a. Contracting Officer (CO) - The CO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the contract terms, and shall safeguard the interests of the United States in the contractual relationship. The CO shall also assure that the contractor receives impartial, fair, and equitable treatment under this contract. The CO is ultimately responsible for the final determination of the adequacy of the contractor's performance. b. Contracting Officer's Technical Representative (COTR) - The COTR is responsible for technical administration of the contract and shall assure proper Government surveillance of the contractor's performance. The COTR shall keep a quality assurance file. The COTR is not empowered to make any contractual commitments or to authorize any contractual changes on the Government's behalf. c. Other Key Government Personnel - N/A 3. CONTRACTOR REPRESENTATIVES The following employees of the contractor serve as the contractor's program manager for this contract. a. Program Manager - TBD b. Other Contractor Personnel - TBD Title: TBD 4. PERFORMANCE STANDARDS Performance standards define desired services. The Government performs surveillance to determine if the contractor exceeds, meets or does not meet these standards. The Performance Requirements Summary Matrix in the Statement Statement of Work (SOW), includes performance standards. The Government shall use these standards to determine contractor performance and shall compare contractor performance to the Acceptable Quality Level (AQL). INCENTIVES The Government shall use Exercise of Option Period (if applicable) and Past Performance as incentives. Incentives shall be based on exceeding, meeting, or not meeting performance standards. 6. METHODS OF QA SURVEILLANCE* Various methods exist to monitor performance. The COR shall use the surveillance methods listed below in the administration of this QASP. a. DIRECT OBSERVATION. (Can be performed periodically or through 100% surveillance.) Acceptable Quality Level: 1% to 100% b. PERIODIC INSPECTION. (Evaluates outcomes on a periodic basis. Inspections may be scheduled [Daily, Weekly, Monthly, Quarterly, or annually] or unscheduled, as required.) Acceptable Quality Level: 1% to 100% c. USER SURVEY. (Combines elements of validated user complaints and random sampling. Random survey is conducted to solicit user satisfaction. May also generate inspections and sampling.) Acceptable Quality Level: 1% to 100% d. VALIDATED USER/CUSTOMER COMPLAINTS. (Relies on the patient to identify deficiencies. Complaints are then investigated and validated.) Acceptable Quality Level: 1% to 100% e. 100% INSPECTION. (Evaluates all outcomes.) Acceptable Quality Level: 1% to 100% f. PERIODIC SAMPLING. (Variation of random sampling. However, sample is only taken when a problem/deficiency is suspected. Sample results are applicable only for the specific work inspected. Since sample is not entirely random, it cannot be applied to total activity performance.) Acceptable Quality Level: 1% to 100% g. RANDOM SAMPLING. (Designed to evaluate performance by randomly selecting and inspecting a sample of cases. Acceptable Quality Level: 1% to 100% h. Progress or status meetings. Acceptable Quality Level: 1% to 100% i. Analysis of contractor's progress reports. (Evaluate cost, schedule, maintenance documentation, etc.) Acceptable Quality Level: 1% to 100% 7. RATINGS Metrics and methods are designed to determine if performance exceeds, meets, or does not meet a given standard and acceptable quality level. A rating scale shall be used to determine a positive, neutral, or negative outcome. The following ratings shall be used: Excellent = Exceeds Standards Satisfactory = Meets Standards Unsatisfactory = Fails To Meet Standards 8. DOCUMENTING PERFORMANCE a. ACCEPTABLE PERFORMANCE The Government shall document positive performance. Any report may become a part of the supporting documentation for any contractual action. b. UNACCEPTABLE PERFORMANCE When unacceptable performance occurs, the COTR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COTR shall document the discussion and place it in the COTR file. When the COTR determines formal written communication is required, the COTR shall prepare a Contract Discrepancy Report (CDR), and present it to the contractor's program manager. The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor has to present this corrective action plan to the COTR. The Government shall review the contractor's corrective action plan to determine acceptability. Any CDRs may become a part of the supporting documentation for any contractual action deemed necessary by the CO. 9. FREQUENCY OF MEASUREMENT a. Frequency of Measurement. During contract performance, the COR will periodically analyze whether the negotiated frequency of surveillance is appropriate for the work being performed. b. Frequency of Performance Assessment Meetings. The COR shall meet with the contractor quarterly via telephone (if necessary, i.e. if any problems exist) to assess performance and shall provide a written quarterly assessment. _____________________________ Signature - Contractor Program Manager _____________________________ Signature - Contracting Officer's Technical Representative A. 10-19.MISCELLANEOUS: The Department of Veterans Affairs (VA) will not be responsible for providing items that normally would be used or required for the safety, or necessity of the employee or patients being transported. 1.At no time will the Contractor leave shuttles on VA premises unless a pick-up or delivery is in process. 2.Contractor employees shall conduct themselves in a businesslike manner at all times while on duty and operating within this contract. 3.In case of a disaster, natural or man-made, Contractor shall be required to utilize all its resources to assist in the emergency transport of employees or patients either to or from their vehicles to the VA Medical Center A. 10-20. REPORTING (PICK-UP, DELIVERY, DEPARTURE) All drivers will he required to report to the COR or AOD on duty at any time a pick-up, delivery, or departure is delayed. Drivers will be required to assist employees or patients on or off the shuttle as necessary. A.10-21.PAYMENT: Payment will be made monthly in arrears upon receipt of a proper itemized invoice monthly pre number of trips to location. A.10-22.SERVICES: The contractor agrees to provide all services specified in this contract for any person determined eligible by the VA regardless of race, creed, color or national origin of the person for whom such services are ordered. In addition, the Contractor warrants that subcontracting will not be resorted to as a means of circumventing this provision. A.1O-23.COMPLAINTS AGAINST DRIVERS: Complaints against driver for inappropriate behavior or discourtesy will be submitted to VA Medical Center Atlanta and may result in VA Medical Center Atlanta requiring Contractor to remove offending driver(s) from service. Drivers who accumulate five (5) unrelated, substantiated complaints in a 12-month period shall be prohibited from providing any further services under this contract. A.10-24. CONTRACTING OFFICERS REPRESENTATIVE (COR) ALTERNATE CONTRACTING OFFICERS REPRESENTATIVE (ACOR) The designated COR and ACOR for this contract will be responsible for monitoring the performance of this contract. Will be authorized to order and accept or reject services performed as to quality and condition. A copy of the designation (with names and contact information) will be furnished to the Contractor after award. The COR/ACOR will be the primary contact for the Contractor at the VA. Upon award, the Contractor will provide a primary point of contact to the COR/ACOR and Contracting Officer for the coordination of daily operational issues. The Contractor and COR/ACOR may periodically make site visits to each other's area of operation in order to gain and maintain a familiarity with each other's internal operations. A.l0-25.PATIENT WELFARE: The Government expects the successful offeror to exercise extreme caution and care in handling of patients. Any abuse of patients will be grounds for default action or termination of the contract. The VA reserves the right to bar any driver from transporting VA beneficiaries should he/she violate any terms of this contract. A.10-26UNACCEPTABLE PERFORMANCE: When Contractor performance does not meet the specifications and requirements of this contract, the COR/ACOR will submit written documentation to the Contracting Officer explaining how performance is considered to be unacceptable. This information shall be provided to the Contracting Officer within three (3) business days after each occurrence. The Contractor shall indemnify the Government when services are not performed within the time frame required under this contract and the Contracting Officer determines the failure to perform was within the Contractor's control and arose from the Contractor's fault or negligence. The Government's acceptance of services not performed within the time frame required under this contract does not substitute a change in delivery requirements, nor does it relieve the contractor from any liabilities contained in this contract. A10-27SPECIAL CONTRACT REOUIREMENTS: 1.CONTRACTOR QUALIFICATIONS: a.Offers will be considered only from Offerors who are financially responsible, and have the necessary equipment and personnel to furnish service in the volume required for all services under this contract. Successful Offerors shall meet all requirements of federal, state and/or city codes regarding operations of this type of service. b.Contractor shall submit the following (Updates required at the pre-work conference): (1) List of all vehicles and identification number(s) (new vehicles must he reported before using) (2) Vehicle type and model. (3) Proof of insurance. (4) Inspection report of all vehicles (5) All required business licenses. (6) Copy of individual valid operator or chauffeur license for drivers. (7) A recent (within sixty days) copy of each driver's state driving record obtained from the Georgia State Department of Motor Vehicles. (8) A personnel roster identifying all Contractor personnel who will be performing contract services. In this document, the Contractor shall identify the name, position title, and work assignment area of each employee. (9) Provide evidence of required training, certifications, licensing and any other qualifications for any personnel performing contract services. 2.CONTRACTOR PERSONNEL QUALIFICATIONS: a.All Contractor personnel performing services under this contract shall meet the qualifications specified in this contract as well as any qualifications required by Federal, State, County and local Government entities from the place in which they operate. Contractor personnel shall meet these qualifications at all times while performing contract services. 1.During the contract period of performance, if the Contractor proposes to add personnel to perform contract services, the Contractor shall submit the required evidence of training, certifications, licensing, and any other qualifications to the COR/ACOR. 2.The Contractor shall not use such add-on personnel to perform contract services until qualifications are reviewed and approved by the COR/ACOR. At no time shall the Contractor utilize personnel to perform contract services who do not meet the required qualifications for the services they perform. b.The Contractor is responsible for ensuring that all drivers providing service under this contract have a valid driver's as required by the state. c.The Contractor shall maintain a record of each employee as to the character, current driving records and physical capabilities of performing the duties of a shuttle driver. This record will be made available for inspection upon request by the Contracting Officer or the COR/ACOR. d.The Contractor will meet or exceed all regulatory agency requirements including patient confidentiality and safety standards. A fee for this service will be paid for by the VA. Patients utilizing this service may reserve a space in the vehicle or share in a group ride in the motor vehicle. Patients may be picked up at a designated location. The fee for this service will be negotiated and determined by the contractor and the VA. Reports, appointments, and other necessary information will be conveyed by radio or telephone to a central location during and on completion of trip. Patients not making a reservation for this transportation service will be accommodated on a first-come-first-served basis after those patients who have made a reservation. The contractor will record all trips. The shuttle service shall require the drivers to be sensitive to the condition and health needs of the patients with an emphasis on courteous customer service and patient safety. The drivers will respond to radio or telephone requests for service at locations determined by VA and patients. This transportation service is akin to a car service and a shared ride arrangement. The drivers will not perform other duties such as custodial and building maintenance tasks. Georgia Works and Affiliated Programs: Georgia Works and affiliated programs provide employment to unemployed individuals for businesses at no cost to the employer. This program has been approved by the U.S. Department of Labor. The contractor may employ participants in such programs for 90 days. The VA will request a wage determination for such employees. If no wage determination is made, such employees must be paid the minimum wages under the SCA.
