Description
COMBINED SYNOPSIS/DRAFT SOLICITATION This is a combined synopsis/draft solicitation for commercial items prepared in accordance with (IAW) the format in Federal Acquisition Requirements (FAR) Subpart 12.6, as supplemented with additional information included in this notice. Henceforth, the final solicitation will be issued in accordance with FAR Subpart 12.603, Streamline Solicitation for Commercial Items and upon issuance it will constitute the only solicitation. Proposals will be requested at that time and a written solicitation will not be issued. The solicitation will be a Request for Proposal (RFP) and the due date for proposals will be stated at final solicitation posting. Synopsis/Draft Solicitation Number: HSCETC-14-R-00003 Provisions and Clauses: Applicable provisions and clauses are incorporated in the attached solicitation document located at Appendix 1. Set-Aside: This requirement is Set-Aside 100% for Service Disabled Veteran Owned Small Business (SDVOSB). The solicitation will be competed among SDVOSBs. Contract Line Items (CLIN): Detailed CLIN descriptions are provided in the solicitation document, located at Appendix 2. Requirement: The Contractor must provide delivery, equipment, installation, board certified radiologist necessary to provide remote interpretation image reads for TB, reports, coverage 24/7, consultation, maintenance, technical support, hardware, software, storage, integration, testing, training, invoicing, transition in and transition out activities. Additional detail on the requirements can be found in the Performance Work Statement (PWS) (Appendix 3). Date: July 1, 2014 Place: See attachment 2 FAR 52.212-1 - Instructions to Offerors - Commercial Items applies to this acquisition. The applicable North American Industry Classification System (NAICS) Code is 621512 for Diagnostic Imaging Centers with a Size Standard of $13.5 MILLION. The Government intends to evaluate offers and award a contract without communications with Offerors. Therefore, the Offeror's initial offer should contain the Offeror's best terms from a price and technical standpoint. The Government reserves the right to make no award. IMPORTANT NOTICE TO OFFERORS: Site Visit: The purpose of the site visits is to show potential Offerors two sites that are representative, but not identical, to the 26 sites included in this requirement. One is a Non-IHSC facility and other is IHSC facility. Security procedures, access requirements, and individual equipment layouts vary between the sites. However, these visits are intended to acquaint potential Offerors of the various unique requirements that are associated with performing services in detainee facilities. All prospective Offerors are invited to participate in a tour of 2 of the 26 facilities. Offeror are allowed to bring a total of 2 persons each to either or both site visits locations. Location #1 Elizabeth (IHSC) Facility 625 Evans Street Elizabeth, NJ 07201 April 15, 2014 Location #2 York (Non-IHSC) Facility 508 Waterworks Rd York, PA 33073 April 16, 2014 The following information is required for participation: Company Name, and name or names of the persons attending the site visit. This information must be emailed to tonya.modlin@ice.dhs.gov and Phyllis.brokenborough@ice.dhs.gov by Friday April 11, 2014 at 12:00 pm (est.) It is required that you bring two sources of Identification with picture (ex. Driver license, passport) Note: Questions regarding the context of this draft solicitation will not be addressed during the site visit. All questions must be in writing and emailed to tonya.modlin@ice.dhs.gov and Phyllis.brokenborough@ice.dhs.gov. 52.212-2 EVALUATION - COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract resulting from the final solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors and procedures are identified in Appendix 4. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. FAR 52.212-3 - Offeror Representations and Certifications. Offerors proposal must include a completed copy. See this clause in its entirety in appendix 2. FAR 52.212-4 - Contract Terms and Conditions - Commercial Items applies to this acquisition FAR 52.212-5 - Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. Additional FAR clauses cited below are also applicable to this acquisition. FAR 52.216-1 - TYPE OF CONTRACT The Government contemplates award of a Firm-Fixed-Unit-Price, Indefinite Quantity contract resulting from this solicitation. Source selection process will be lowest price technically acceptable. 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to the expiration of the current contract period. 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (A) THE GOVERNMENT MAY EXTEND THE TERM OF THIS CONTRACT BY WRITTEN NOTICE TO THE CONTRACTOR WITHIN 90 DAYS PROVIDED THAT THE GOVERNMENT GIVES THE CONTRACTOR A PRELIMINARY WRITTEN NOTICE OF ITS INTENT TO EXTEND AT LEAST 60 DAYS THE PRELIMINARY NOTICE DOES NOT COMMIT THE GOVERNMENT TO AN EXTENSION. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years, 6 months. 52.237-3 Continuity of Services (Jan 1991) (a) The Contractor recognizes that the services under this contract are vital to the Government and must be continued without interruption and that, upon contract expiration, a successor, either the Government or another contractor, may continue them. The Contractor agrees to- (1) Furnish transition in and out plan; which includes plan for continued services (2) Exercise its best efforts and cooperation to effect an orderly and efficient transition to a successor. (b) The Contractor shall, as required by the contract, (1) furnish transition in plan with its proposal and a transition out plan which is due prior to contract expiration and (2) negotiate in good faith a plan with a successor to determine the nature and extent of transition in, transition out services required. The plan shall specify a training program and a date for transferring responsibilities for work described in the plan, and shall be subject to the Contracting Officer's approval. The Contractor shall provide sufficient experienced personnel during the phase-in, phase-out period to ensure that the services called for by this contract are maintained at the required level of proficiency. (c) The Contractor shall allow as many personnel as practicable to remain on the job to help the successor maintain the continuity and consistency of the services required by this contract. The Contractor also shall disclose necessary personnel records and allow the successor to conduct on-site interviews with these employees. If selected employees are agreeable to the change, the Contractor shall release them at a mutually agreeable date and negotiate transfer of their earned fringe benefits to the successor.
