Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, Roudebush VA Medical Center 583-14-2-096-0931. 2.Nature and/or Description of the Action Being Processed: Specialized Disposable Surgical Tools for Cardiac Surgery. 3.Description of Supplies/Services Required to Meet the Agency's Needs: $8,600, Atricure, 6033 Schumacher Park Drive, West chester, OH 45069. Specialized Disposable Surgical Tools for Cardiac Surgery, 1 ea, Atricure Isolator, 1 ea Atraclip, standard handle, 1 ea clamp, long jaw, 1 ea Atriclip. Delivery by April 24, 2014. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This order is being placed for disposable instruments for the AtriCure Isolator surgical system in use at the Richard L. Roudebush VA Medical Center for Left Atrial cardiac surgeries. This set of disposable instruments works exclusively in conjunction with the AtriCure Isolator surgical system. Our cardiothoracic surgeons are trained on this system and use it for Open heart surgery patients. These instruments can only be purchased form the OEM vendor. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: FSS and the Internet were searched with no results. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: $8,660. This price is fair and reasonable based on historical pricing for these items, PO 583Q18819 awarded 8/27/2011 shows the same pricing for items 1 and 3, $2,900.00 and $900.00. PO 583Q22278 awarded 1/10/2012 shows the same price for item 2, $900. PO 583Q92126 awarded 12/29/2008, shows similar pricing for item 4, $1,500 (2014 price is $1900). 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: FSS and the internet were searched with no results.
