- Justification Solicitation The D e fense Information Technology Contracting Orga n ization (DI T CO), Contracting Division, Net- C e nt r ic S e r vices Branc h, S of t w a r e Section (DITCO/PL832 1 ), 2 3 00 East Drive, Scott A F B IL 6 2225-5406, intends to issue a sole source award to Microsoft Corporation. Army CIO/G6 is requesting t h e extended support for Microsoft Windows XP as an Army-wide Custom Support Agreement (CSA). Microsoft will be required to provide 100% of the product and technical services required to execute the CSA. As a result, a small business set aside is not possible since a small business would be affiliated with the OEM (Microsoft, large business) and would fall under the ostensible subcontractor rule, 13 C.F.R. 121.103(h)(4). Additionally, under 52.219-14, at least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern for services. Because the services would require Microsoft, a large business, to perform over 50 percent of the software solution, a set aside is not possible.
