Description
THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Leica Microsystems, Inc., 1700 Leider lane, Buffalo Grove, IL 60089 for maintenance service of Leica SP5 microscope equipment and TIRF autofocus module system. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code is 811219 - Other Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $19.0 Million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-72, Effective 30, January 2014. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR Subpart 6.302- (1) FAR 6.302-1-Only one responsible source and no other supplies or services will satisfy agency requirements. PROJECT DESCRIPTION This is a requirement for service and maintainance of the Leica SP5 microscope (equipment number 10544448, Serial number 5100000328 described as "SP5 UV/405 AOBS MP 561 LASER FLIM") and TIRF autofocus module system (equipment number 10767353, Serial number 311265, described as "DMI6000TIRF MC") operated by the NIAMS Light Imaging Section. The proposed contractor does not certify third party organizations to perform service on its equipment and as the original manufacturer, can supply spare or replacement parts in addition to instrument software revisions, which is provided with the maintenance contract. The proposed contractor is the sole manufacturer of these equipment and the sole provider of the maintenance service for these equipments. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by April 22, 2014 at 6 pm Eastern Standard Time (EST) and must reference number HHS-NIH-NHLBI-CSB-AR-2014-100-IM.
