- 1.07 - please send us Form 1364, 1217, 3518A and any Lease Amendments. RESPONSE: These documents were attached to your email dated 2/26/2014; however, I will resend as the 1364 has been revised. Complied on 3/28/2014 2.01(N)3 - Since this space will be wholly contained (nothing is shared or common space), none of these areas will be deducted? Incorrect RESPONSE: The areas listed should be deducted from the inside gross area, determined in accordance with 2.01(N)2, to determine the net usable square feet. 2.07 - Our method would be to quote a fixed base rent with an estimated amount for operating costs, real estate taxes, and insurance, that would be analyzed each year with either an overage or shortage. RESPONSE: The 1217 shall be completed with actual costs experienced over the past twelve months for a similar type building. The Government procures an official appraisal of the property(s) being considered to determine the Fair Market Rental Rate on the Net Usable Square Foot Building area on a net rental rate basis for the building shell only. 3.07(D) - wood plywood on walls in data/electrical room would be fire treated, but normally, misc pieces of wood backing inside the walls, doors and trim are not fire treated. RESPONSE: Wood blocking in walls should be fire treated. Doors and trim are not required to be fire treated. 277/480 volt electric service is not available and typically is not in this size building. RESPONSE: 277/480 volts is not required for this occupancy. 120/208 volts should be adequate. Complied on 3/27/2014 3.15(D) - Installed fire alarm will transmit to a central station via an internet connection that will be provided by tenant. RESPONSE: The means of transmitting the fire alarm signal to a remote monitoring location is the responsibility of the Lessor. 3.23(A) - Standard doors are 36", not 3'-6", I would think that this is a misprint, please confirm. These doors would have tempered glass, but insulated glass was not required to pass the energy code. RESPONSE: The exterior doors shall be 3'-6" to accommodate bariatric wheel chairs. Insulated tempered glass is required to cut down on the heat load transmitted to the interior of the building, not expressly to pass the energy code. 3.37 - Typically in this size/type building, you do not install a circulating hot water system. RESPONSE: A hot water recirculating system in this size and type of building is not required. Deleted on 3/27/2014 3.39(A)1 - All plumbing will be PVC/CPVC and meets the plumbing code. In this type facility, electronic faucets are not usually used. RESPONSE: Faucets with electronic sensors are required. PVC/CPVC piping is acceptable, providing the pipe, fittings, and solvent cement meet NSF/ANSI 14 and shall be NSF listed for the service intended. 3.39(B)5 - Landlord does not supply coin operated sanitary napkin dispensers. The Tenant can have their vending company supply. RESPONSE: Delete requirement for coin operated sanitary napkin dispensers. VA shall provide a sanitary napkin disposal receptacle, installed by Lessor. Complied 3/27/2014 3.42(F) - No pre-filter is normally used and the standard MERV is 11. RESPONSE: A pre-filter is not required. Filter with a MERV of 11 is acceptable. Corrected on 3/27/2014 3.43(C) - In this type/size office, usually a Lenal card reader system is overkill, particularly taking into account the maintenance of changing cards, etc. A standard key lock system is more appropriate. RESPONSE: VA security requirements mandate the specified card reader on communications closets. 3.43(G)6 thru U- are not installed by Landlord. Due to liability of system, the Tenant's IT contractor should install these items. RESPONSE: The tenant does not have an IT contractor. The Lessor shall be responsible for securing the services of a contractor/subcontractor qualified to perform the specified work. The requirements are amended as follows: 1. 3.35(H) - Revise 1st sentence to read, "Color coding for telephone/data cables shall be green. 2.3.35(I) - Revise 1st paragraph to read as follows: "Each TCO shall consist of a blank and three data multi pin jacks for a triplex outlet, mounted with a faceplate that shall be industrial grade plastic with clear permanent labels. The TCO, except wall phones, shall be triplex type jacks, with a four position, flush mounted faceplate. The jacks shall be a minimum eight position RJ-45 female type unkeyed (sometimes called center keyed) jacks. The TCO shall support the following minimum operating parameters:" 3.3.35(T) - ADD the following to the end of paragraph T, "Install a motion detector connected to the building alarm system in the Telephone/Data room. Install door contacts on the door to the Telephone/Data room, connected to the building alarm system." Complied on 3/28/2014 3.45(G) - Due to this being a ground floor office with battery backed-up exit and emergency lights, no backup generator will be installed. RESPONSE: A backup emergency generator is not required. Deleted 3/28/2014 4.01(C) - Construction would typically be 120 days after building permit is issued. RESPONSE: SEE REVISED SECTION 4 Complied on 4/3/2014 5.15(A) - Air conditioning equipment will be split systems as opposed to package systems due to design of building. RESPONSE: The only split system is the system for the Telephone/Data room. Air conditioning equipment for remainder of building shall be in accordance with Section 5.12, Heating and Air Conditioning. Revise paragraph 5.12.B as follows: DELETE last two sentences beginning, "Minimum cooling ¦ ¦.." and "Additional cooling ¦ ¦ ¦ ¦.." Complied on 3/28/2014 5.15(B) - alarm notice will be provided if Tenant provides an internet connection. RESPONSE: Lessor shall be responsible for providing means for remote alarm notification. 5.15(C) - Air conditioning zones will be provided to accommodate the building design to adequately maintain temperature control. RESPONSE: Temperature control shall be per paragraph 5.12(C). 5.19 - Landlord will provide a data/phone box at the appropriate locations with a conduit to space above ceiling. All cabling, wire trays, terminations, testing will be the responsibility of the Tenant. RESPONSE: The Lessor shall be responsible for securing the services of a contractor/subcontractor qualified to perform the specified work. 6.01 - If Tenant extends normal business hours, appropriate adjustment of operating costs will be based on increase in operating costs. RESPONSE: Rachel: 1.Revise the normal hours of operations to 7:00 AM to 5:30 PM. 2.DELETE the last sentence of Section 6.01. This statement is based on a lease where the utilities cost is paid by the VA. Per Section 6.02, Utilities, the cost of utilities is the Lessor's responsibility. Revising the operation hours as in item no. 1 above should give the VA time to get in and out and use beyond those hours would not be required. Complied on 3/28/2014 6.07(B)1 - No written weekly report will be required, if there is any problem with janitorial service, Tenant will notify Landlord for satisfaction. RESPONSE: Deleted 6.07(B)2 - Janitorial staff will come in once a day during normal business hours. RESPONSE: Provide services as required by 6.07(B)2. 6.07(B)3 - delete no police record requirement. RESPONSE: Lessor shall comply with requirement that none of the janitorial staff may have a police record for anything more serious than traffic or parking violations. 6.07(B)4 - No red bag or hazardous materials involved. RESPONSE: DELETE 3rd sentence of 2nd paragraph Complied on 3/28/2014 6.07(C)7 - Bathrooms will be cleaned once a day. RESPONSE: REVISE 1st bullet to read, "All restrooms shall be cleaned, swept, and wet mopped once per day." Complied on 3/28/2014 6.12(A)1 - Repaint every 5 years, this will not preclude minor touchups occasionally by Landlord. RESPONSE: Common areas would only be lobby/waiting space, public restrooms, and any main corridors, which is not a lot. REVISE 6.12(A)1 to read, "Lessor shall repaint common areas (lobby/waiting areas, public toilets, and main corridors) at least every 3 years. Remainder of building shall be painted at least every 5 years." DELETE the 1st sentence of 6.12(A)2. Complied on 3/28/2014 6.12(B)2 - Change carpet every 5 years, this would not preclude the Landlord changing a room on occasion. RESPONSE: REVISE to read as follows: "Carpet tiles shall be replaced when tiles become worn, stained, loose, frayed, torn, etc. All carpet tile in the space shall be replaced every 5 years." Complied on 3/28/2014 6.15 - Delete since sub-contractors would only be in space during normal business hours. RESPONSE: Requirements of this section are a mandatory security requirement. Sub-contractors are not accompanied by VA personnel at all times. Lessor shall comply with the requirements of this section. 6.17(A)3 - Delete - On this size/type project, composting and recycling is not feasible. RESPONSE: DELETE 6.17(A)3. Complied on 3/28/2014 6.28 - The Landlord will cooperate, but will not participate - again due to the size and type of building. RESPONSE: Revise 6.25 to read as follows: "The Lessor shall cooperate with the Government's Occupant Emergency Plan (OEP), and the development and implementation of emergency notification procedures for the Lessor's Building Engineer or Manager. The Plan will include, among other things, an annual emergency evacuation drill, emergency notification procedures for the Lessor's Building Engineer or Manager, building security, local emergency personnel, and Government agency personnel." Complied on 3/28/2014 Rachel, REVISE 5.11.A to DELETE, "Broadloom carpet or ¦ ¦ ¦", and capitalize "carpet ¦ ¦.". Complied on 3/28/2014 REVISED RLP DOCUMENT WILL BE PROVIDED UPON REQUEST, via email.
