Description
The Department of Energy, Western Area Power Administration, Sierra Nevada Regional Office, awarded a limited sources, Unusual and Compelling Urgency award as indicated. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS The Below Justification cites the required basis for this award. Justification for Other than Full and Open Competition Limited Sources Western Area Power Administration FAR 6.302-2 Unusual and Compelling Urgency DE-WA0001805 1. Identification of the agency and the contracting activity. Western Area Power Administration, Sierra Nevada Regional Office (SNR) 114 Parkshore Drive, Folsom CA 95630 2. The nature and/or description of the action being approved. The procurement will be accomplished by a competed firm fixed-price construction contract. The estimated dollar value of the contract is between $500,000 and $1,000,000. 3. A description of the supplies or services required to meet the agency's needs. The construction contract will provide for the complete replacement of the Tracy-Tesla Approach Structure and replacement of components of the Tracy-Tesla Take-Off Structure with Government-furnished materials for the above ground components. Concrete and rebar for the foundations will be contractor-furnished material. The contract will also require the contractor to transfer the existing conductors from the existing structures to the new structures 4. The statutory authority permitting other than full and open competition. This contract action will be processed in accordance with Federal Acquisition Regulation (FAR) 6.302-2, 41 U.S.C § 253(c)(2), which allows for other than full and open competition for an unusual and compelling urgency. 5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority. The two structures, indicated in Item 3 above, have had numerous cracks and defects in welded connections requiring repair or replacement. In the past there has been several repairs performed to these welds, almost from the time the structures were erected, but the cracks reappear. Field repairs are undesirable and possibly dangerous with the structures under loads exceeding 10,000 pounds and because the repairs would have to be done at an elevated height, in not ideal conditions, and one of the spans attached to the approach structure crosses over several transmission lines and a frequently traveled roadway. These structures support transmission lines that are currently under an outage for another project. This outage presents an ideal situation to replace/repair these structures; however, the outage is scheduled to expire on June 3, 2014. It currently took over a year to get this outage coordinated. Outages on this transmission line are difficult to arrange and have economic impacts. It is uncertain when another outage of suitable duration could be arranged. In order to take advantage of this outage, an accelerated solicitation process is required. 6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable. Four known contractors were contacted and will be sent Requests for Proposal. In accordance with FAR 5.202(a)(2), no notice will be submitted to the Federal Business Opportunities (FBO) web site. 7. Cite the anticipated dollar value of the proposed acquisition including options if applicable and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The estimated award value is between $500,000 & $1,000,000. Price fair and reasonable shall be on the basis of a competitive award with two or more proposals received. 8. A description of the Market Research (MR) conducted and the results or a statement of the reason MR was not conducted. Limited market research was conducted. Four contractors that have successfully performed similar work for Western were contacted and agreed to provide proposals for this work. Further market research could not be conducted due to the urgent and compelling nature of this procurement. 9. Any other facts supporting the use of full and open competition limited sources such as: This line is critical to power deliveries and reliability throughout the Central Valley Project area of California. Failure to correct this situation is a potential danger to public safety as well as the power system and associated equipment. Failure of one of the structures would result in the 500,000 volt conductor falling to the ground potentially resulting in serious injury or loss of life. 10. A listing of the sources, if any, that expressed a written interest in the acquisition. Western solicited the following four companies to submit proposals: Brink Constructors, Inc. Wilson Construction Company PAR Electrical Contractors, Inc. Summit Line Construction, Inc. 11. A statement of actions the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated. There is none.
