- Notice of Intent for Sole Source Procurement Procurement Office : United States Environmental Protection Agency, Superfund Regional Operations Division (3805R) 1200 Pennsylvania Avenue NW, Washington, DC 20004 Response Date: April 10, 2014 3pm EST. Background The U.S. EPA National Exposure Research Laboratory (NERL) is in need of repair on a 3730 DNA Sequencer. The item in need of repair on this piece of equipment is the CD Camera part number 625-1512. Sole Source Justification This procurement is recommended to be processed without full and open competition for the repair services to be performed by Life Technologies by Applied Biosystems, LLc. The repair technicians are the only specifically trained by the manufacture to service devices such as the Applied Biosystems 3730 DNA Sequencer. They use replacement parts that meet all requirements of the manufacture, and many of these parts are only available to others Life Technologies technicians. Only these technicians may utilize the manufacture?s technical support. Conversely, having repairs completed by another repair service would make this equipment ineligible for help from the manufacture?s technical support. Life Technologies does not authorize any third-party service provider in North America to perform maintenance and repair on Applied Biosystems instruments. Life Technologies is the only manufacturer authorized service provider for Applied Biosystem instruments. Life Technologies maintains IP rights to its collection software and service tools software. Third party resellers and service providers are strictly prohibited from accessing, using or selling this software. AUTHORITY AND FAR REFERENCE The basis for this recommendation is 13.106-1(b). Life Technologies is located at 5791 Van Allen Way. Carlsbad, CA 92008. The North American Industry Classification System (NAICS) code is 811219. The EPA's determination is that there is only one responsible source capable of satisfying this requirement. There is NO SOLICITATION for this requirement. Any firm that believes it is capable of meeting these requirements will be considered. Responses to this posting must be in writing and provide clear and convincing evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government. Written responses must be submitted via email to the sole point of contact, Frank Bottalico, Contracting Officer at Bottalico.Frank@epa.gov no later than 3:00 pm Washington DC local time on Thursday April 10, 2014. No telephone inquiries will be accepted.
