DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition Contracting Activity: The U.S. Department of Veterans Affairs, Contracting Office HAC Denver- SAO East, proposes to enter into a contract on a basis of other than full and open competition for the VHA CBO (Health Administration Center), located in 3773 Cherry Creek North Drive, Denver, Colorado, 80209. 2237#: 741-14-2-1302-0015 Restricted to the following source: Manufacturer/Contractor: DISA X12 Secretariat Manufacturer/Contractor POC & phone number: info@disa.org (703) 970-4480 Mfgr/Contractor Address: 7600 Leesburg Pike, East Bldg., Ste 430, Falls Church VA 22043 Dealer/Rep address/phone number: N/A 1.Nature and/or Description of the Action Being Processed: The purpose of this action is for a Sole source Justification Service Order for: a Membership to the Accredited Standards Committee (ASC) X12 organization will allow VHA's payer organization (Purchased Care) to participate in the development and support of electronic exchange standards and related documents for HIPAA mandated transactions. 2.Description of Supplies/Services Required to Meet the Agency's Needs: (a) Participation in setting electronic data interchange standards (ASC X12) that will be imposed upon the health care payer and provider communities at the elemental level. (b) Estimated dollar value : $4,077.00 (c) Required Delivery Date: 04/01/2014 3.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 4.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Accredited Standards Committee X12 organization was chartered by the American National Standards Institute (ANSI) and is recognized by the Department of Health and Human Services' Centers for Medicare and Medicaid Services as a Standards Development Organization (SDO) for mandated HIPAA medical transactions. While there are other SDOs, they focus on specific communities and specialties in electronic healthcare transactions. For example, the National Council for Prescription Drug Programs (NCPDP) is an SDO responsible for setting transaction standards for retail and commercial pharmacy providers, payers and benefit managers. The Electronic Payments Association - NACHA - focuses primarily on the standards and operating rules for the transfer of funds using electronic transactions. ASC X12, likewise, focuses on the standards for electronic eligibility inquiries and responses, claims, claim status inquiries and responses, pre-authorization inquiries and responses, remittance advices, enrollment, premium payments and claim attachments for medical and dental providers, payers and support services such as clearinghouses and value-added networks. The Workgroup for EDI (WEDI) is a related association which does not develop standards or operating rules. The ASC X12 organization is the single source for this function. 5.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: See Paragraph 8 6.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable, due to the fact that this is the only vendor who can provide this membership. Membership fees are established and controlled solely by DISA and are the same for all agencies/customers who are voting members. 7.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A review was done of the SDOs listed in HIPAA legislation, including searches of those organization's websites for purpose, scope, benefits and cost. See wedi.org, ncpdp.org, x12.org, nacha.org. 8.Any Other Facts Supporting the Use of Other than Full and Open Competition: The membership fee covers the entire CBO Purchased Care organization and allows participation by one or more staff, as appropriate, in the standards setting process. Participation in this function is critical to CBO Purchased Care to 1) influence the format and function of electronic transactions and 2) obtain deep institutional knowledge of the intent and structure of modifications well in advance of CMS notification of mandated version changes. ASC X12 is not a professional association in that it is not providing support, training or certification functions for EDI Professionals. 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: DISA 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The market place will be monitored for other sources providing like services.
