RESPONSES TO THIS MARKET SURVEY SHALL BE FOR INFORMATIONAL PURPOSES ONLY. THE GOVERNMENT WILL NOT REIMBURSE RESPONDENTS FOR ANY COSTS INCURRED IN PREPARATION OF A RESPONSE TO THIS NOTICE. 1. Note, In accordance with Section 42(c) of the Arms Export Control Act, as amended (22 USC 2791(c)), the Foreign Military Financing funds made available for this procurement may not be used to award to other than a United States firm. Offers from other than United States firms are ineligible for award. 2. CONTRACT INFORMATION: The Transatlantic Division, Middle East District (TAM), U.S. Army Corps of Engineers (USACE) is evaluating the ability of businesses interested in the design and construction of a Sea Survival Training Center and Refurbishing of a Floating Pier at Aden, Yemen. The Government is performing market research in order to specifically determine the capability of the potential offerors to perform the work specified below. It is anticipated that a solicitation announcement will be published on the Federal Opportunities website (https://www.fbo.gov) in the near future. The solicitation will consist of multiple Contract Line items (CLINS), which will be Firm Fixed Price (FFP). The estimated cost of this project is between $1,000,000.00 and $5,000,000.00. Performance and payment bonds will be required with an estimated period of performance of 730 days after issuance of the notice to proceed. 3. PROJECT INFORMATION: The United States Army Corps of Engineers has the requirement for the construction of Sea Survival Training Center, and the repair of a floating pier pontoon in the near-shore waters of the Gulf of Aden. The features of work are expected to include a swimming pool with deep end beyond 3 meters in depth, a single building adjacent to the swimming pool, and all associated civil/site/utilities necessary, and the repair of a floating pier pontoon at a nearby waterfront in Aden. Pier Refurbishing Aden, Yemen -Construction of a Sea Survival Training center -Refurbish the installation of the floating pier in Aden The construction of the swimming pool project site will be located within the boundaries of a military controlled area in Aden, Yemen. 3. Required Qualifications: Interested parties must be licensed to perform work in Yemen. Eligible Contractors will be limited to: (1) U.S. firms, or (2) Joint Ventures between U. S. Firms, or (3) Joint Ventures between U. S. firms and Yemeni firms. To be considered a U. S. firm, the firm must be incorporated and have its corporate headquarters in the U.S. for a minimum of three years; shall have filed state and federal income tax declarations for a minimum of three corporate years within the preceding four-year period, having paid any applicable taxes determined to be due as a result of such filing; and employ U. S. citizens in key management positions. To be considered a U.S firm, the firm must be a minimum of 51 percent U.S ownership. 4.
