Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (J&A) 1. Defense Logistics Agency (DLA) Troop Support, Construction and Equipment (C&E) Supply Chain, is the contracting activity. 2. The action being approved is the ability to solicit for supplies on an other than full and open competition basis. 3. This contract will provide for purchasing the complete line of US Army Tank Automotive and Armaments Command (TACOM) approved LoadTamer cargo nets manufactured by Networks Enterprises. Following is a list of the various cargo nets and related parts and supplies required to meet the needs of the Government. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), only one responsible source and no other supplies will satisfy agency requirements (FAR 6.302-1). 5. The use of this authority is necessary because Networks E nterprises is the only known, approved manufacturer of cargo nets that meet the unique needs of the Government for safe and efficient transport of cargo in battlefield conditions. The cargo nets safely restrain cargo in/on combat vehicles, trucks, trailers and boats and prevent items from bouncing/shifting or blowing out of the cargo area. These cargo nets have a unique design and are specifically manufactured to fit each transport application. They feature two patented elements - a sewn rope boarder and adjustable cinch rope - allowing for height adjustments to accommodate any load configuration. (The patented rope border is sewn rather than overcast, which ensures the rope border will never come loose from the net and the adjustable cinch rope provides a single adjustment/tightening point versus multiple tie down points.) The cargo nets are also constructed from webbing using a double needle bar composition off the loom, which considerably strengthens the net. (Other nets are constructed of a single stitch loomed variant resulting in half the strength, 680 lb. bar break vs. 320 lb. bar break.) The Networks Enterprises cargo nets are knotless and consist of non-elastic 2" squares manufactured from ultraviolet light treated black woven nylon. The only similar, commercially-available cargo net is made from elastic cordage with 12" squares. Ultraviolet light destroys the elastic material and the larger netting and rope does not conform to the shape of the cargo; thereby, allowing it to shift or escape through the larger squares. In January 2006, the Tactical Wheeled Vehicles (TWV) Technology Component Demonstrations were held at the Yuma Proving Ground in Arizona. At this time, Networks Enterprises and AMTI (Applied Marine Technology Inc.) demonstrated their cargo restraint systems on various types of combat vehicles. The Enterprise Market Investigation Process (EMIP) team from TACOM, consisting of engineers, logisticians, user representatives, test representatives and subject matter experts, observed the demonstrations. In March 2006, TACOM's Program Executive Office for Combat Support recommended that Networks Enterprises' Load Tamer Cargo Restraint System be stocked as a class IX item of supply and that it be incorporated in remaining TWV platforms and trailers. Currently, Networks Enterprises is the only TACOM approved source for cargo nets used on various combat vehicles. 6. The proposed acquisition was synopsized in FedBizOpps. In addition, this J&A will be posted with the solicitation in accordance with FAR 6.305(c). 7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on price analysis, with consideration given to current and historical prices and developing a Fair Market Price (FMP) based on current market conditions for similar items. 8. A Sources Sought Notice was posted on FedBizOpps on February 28, 2013 and a follow-up was posted on April 23, 2013. One vendor, Cargo Safetyweb, expressed an interest in submitting an alternate item offer. Cargo Safetyweb was advised to submit details on the alternate item to the product specialist for evaluation by TACOM. To date, this information has not been received. 9. The rights to the technical data for the required nets are proprietary to Networks Enterprises. The AMC/ AMSC code has been reviewed and revised to 3P (Sole Source, data available is proprietary). 10. Networks Enterprises and Cargo Safetyweb are the only firms expressing an interest in the proposed procurement. 11. Defense Logistics Acquisition Directive (DLAD) 52.217-9002, Conditions for Evaluation and Acceptance of Part Numbered Items, encouraging the submission of offers for alternate products will be included in the solicitation. Prior to option exercise, a technical review and market research will be conducted in an attempt to identify additional sources. 12. As the contracting officer, I hereby certify that this Justification is accurate and complete to the best of my knowledge and belief.
