- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION UNDER FAR 6.303-2 Open Market Acquisitions and FAR 13.5 Special Test Items 1. Contracting Activity. The contracting activity for this acquisition is: USDA, ARS, ATTN: Shelley C. Steen, Contracting Officer 3793 N. 3600 E. Kimberly, ID 83341 (208) 423-6568 2. Nature/Description of Action. This action is for the purchase of an open path FTIR from Cerex Monitoring Solutions. 3. Description of Supplies/Services. This is an open path Fourier Transform Infrared Spectrometer which will be used to measure concentration of ammonia, methane and nitrous oxide from dairy production sites. 4. Statutory Authority. FAR 13.501(a)(1)(ii). 5. Demonstration of Contractor's Unique Qualifications. We have chosen this unit as we already have one FTIR unit from Cerex and we have developed specific software to more accurately quantify gas concentrations using the Cerex unit. Therefore in order to utilize the software and be consistent with our current field monitoring equipment we would like to purchase an identical unit. 6. Federal Business Opportunities (FedBizOpps) Announcement/Potential Sources. N/A 7. Determination of Fair and Reasonable Cost. Price reasonability has been proven by market research. There is one other system on the market, but it is more expensive than the unit being requested. 8. Market Survey. There is one other unit in the marketplace, but it is more expensive than the equipment we wish to purchase. Additionally, we can utilize expertise developed in the Kimberly location with legacy equipment from the same vendor. 9. Additional Support. The Kimberly unit has already made a substantial investment in earlier versions of this equipment and consumables from this particular vendor. Further, we have invested in software development to enhance the data quality from these units. We also have a good working relationship with the vendor which has enabled us to obtain free advice and troubleshooting as well as maintain and fix the equipment at reduced rates. 10.
