Description
Amendment 0003 of subject Pre-Solicitation Notice #P14PS00489 is issued to include the following information regarding FAR Clause 52.219-14 Limitation on Subcontracting (DEC 1996) into this Pre-Solicitation Notice. In reference to FAR Clause 52.219-14 - Limitations on Subcontracting - The National Defense Authorization Act for Fiscal Year 2013 has passed and amended the Small Business Act to provide that, for purposes of the limitations on subcontracting, costs incurred by a small business prime contractor on its "similarly situated" small business subcontractor shall not be considered subcontracted costs.... SIMILARLY SITUATED ENTITY - The term "similarly situated entity" means a subcontractor that --- (a) if a subcontractor for a small business concern, is a small business concern; (b) if a subcontractor for a small business conceern eligible to receive contracts under section 8(a), is such a concern; (c) if a subcontractor for a small business concern owned and controlled by women (as defined in section 8(m)), is such a concern; (d) if a subcontractor for a small business concern owned and controlled by women (as defined in section 8(m)) that is not less than 51 percent owned by 1 or more women who are economically disadvantaged (and such ownership is determined without regard to any community property law), is such a concern; (e) if a subcontractor for a qualified HubZone small business concern, is such a concern; or (f) if a subcontractor for a small business concern owned and controlled by service-disabled veterans, is such a concern. The National Defense Authorization Act of 2013 permits prime contractors to meet the requirements of the limitations on subcontracting clause by including work performed by similarly situated subcontractors. The FARs limitations on subcontracting clause allows the prime contractor to count small business subcontractors toward the primes own performance requirement. THE DUE DATE/TIME FOR SUBMISSION OF QUALIFICATIONS IS EXTENDED TO: 5:00PM MT on April 4, 2014.
