- The Department of Veterans Affairs, SAO East, VISN 4, Station 540, Louis A. Johnson VAMC (LAJVAMC), 1 Med Center Drive, Clarksburg WV intends to procure on a sole source basis with the large business, Alcon Laboratories, Inc. at 6201 S. Freeway, Fort Worth, TX. 76134-2001 This procurement is for the purchase of software upgrades for existing Alcon Infiniti Vision System; more specifically the Ultravit Pneumatic, located at the facility address listed above. The method of procurement shall be a firm fixed price contract for the procurement stated herein. The North American Industry Classification System (NAICS) code shall be 541519. The commodities are to upgrade the Alcon Infiniti Vision System and may require the contractor to provide user training and support to LAJVAMC OR (Operating Room), Sterile Processing Service (SPS), Information Resources Management (IRM) and Biomedical staff. The contractor is required to have specific training and certification on all Alcon Infiniti Vision equipment. The Government intends to procure with only one source under the authority of FAR 6.302-1 and FAR 15.308. This notice of intent is not a request for quotations. Interested parties who believe they can meet these needs must reply to this notification by emailing mario.bombardiere@va.gov no later than 12:00PM EST, March 26, 2014. All information shall be furnished at no cost or obligation to the Government. This award will be made using commercial acquisition procedures in accordance with FAR PART 12. The anticipated award date is April 2, 2014. A determination by the Government not to compete this proposed contract is solely within the discretion of the Government. Telephone or faxed inquires will not be accepted. DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 04, Louis A. Johnson VA Medical Center, Station 540, Justification for Other than Full and Open Competition, PR 540-14-1-072-0005 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the brand name procurement of INFINITI UltraVit Pneumatic software upgrade manufactured and serviced by Alcon Industries Inc. for the Alcon Infinity Machine. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Alcon Infinity Machine is currently owned by our facility and used exclusively for Ophthalmology service within the operating room. The upgrade in software will enable this machine to accommodate Vitrectomy type surgical procedures within the Operating Room and make it function exactly like the newer Alcon Infinity Machine. This software upgrade is required to make the Alcon Infinity Machine compatible with existing supplies and instrumentation currently used at our facility and within the Operating Room. This software upgrade will be installed on our current Alcon Infinity Machines to be used on our cataract surgery patients where there is a need to cut vitreous gel that may present through or around the posterior capsule, vitreous traction raised the incidence of complications including retinal detachment and endophthalmitis. Proper management of this requires a rapid cut-rate on the Vitrector, and this software upgrade will provide the necessary changes to perform the procedure. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a.Only One Responsible Source (FAR 6.302-1): Alcon Laboratories Inc. is the sole manufacturer of the equipment and software with its own proprietary rights. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Posting Notice of Intent to Sole Source to FBO. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The software upgrade will be performed on two (2) machines at an estimated cost of $5,900.00 for each. A new machine is approximately $38,000.00. To perform the upgrade will provide a significant cost savings to our facility versus procurement of new machines. Pricing was also compared to other similar products provided by Alcon Industries Inc. for system upgrades and was determined to be reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research of Federal Business Opportunities (FBO), Federal Procurement Data System (PFDS), GSA, and NAC did not find any additional vendors under contract with the capability of providing the requested system upgrade. Alcon Industries Inc. is the sole vendor with proprietary rights and the only vendor capable of upgrading their own equipment; no other business can provide service on their product. Although this product is not on contract, the vendor has been awarded NAC Contract #V797P-2046D for similar items. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: NA 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: NA 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: NA
