- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a Firm-Fixed-Price Delivery Order (DO) issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC) for renewal of RadiantLogic maintenance. The period of performance for the maintenance and support shall be 12 months from April 9, 2014 to April 8, 2015 with three 12-month option periods. 3. Description of the Supplies or Services: The proposed action is for the renewal of three Annual Maintenance and Support Premium subscriptions for RadiantLogic RadiantOne Virtual Director Server (VDS) Context Edition Production licenses and two Annual Maintenance and Support Premium RadiantLogic RadiantOne VDS Context Edition-Non Production licenses. The RadiantLogic RadiantOne VDS is a federated identity platform which enables authentication and fine-grained authorization for identity management and context-driven applications. The VDS is designed specifically to solve data integration challenges for non-disruptive deployments in high-volume, high-complexity identity environments, without customization. The RadiantLogic RadiantOne Premium Annual Maintenance and Support includes initial access to product upgrades, productivity enhancements, versions, releases, workarounds, bug fixes, and security/functional patches to licensed product(s). This support shall be available via e-mail, web, phone and knowledge base to support maintenance and troubleshooting. The contractor shall deliver premium annual maintenance and support services for the three RadiantLogic RadiantOne VDS production and for the two RadiantLogic RadiantOne VDS non-production software licenses. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: Based on extensive market research, as described in paragraph eight of this document, it was determined that limited competition is viable among resellers for this brand name requirement. This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. RadiantLogic or resellers of the brand name RadiantLogic can meet VA's requirements. In April 2013, VA procured the original software licenses with associated maintenance and support. The maintenance and support is due to expire on April 8, 2014. The RadiantLogic RadiantOne VDS software is the only brand name product that can provide identity aggregation for lightweight, proxy-based integration, subsystem integration for homogeneous identity sources and complete integration for a fully integrated, merged system. Furthermore, Specialized Access Control (SAC) service has been established to standardize and centralize the control of end-user access to VA systems, data, and other resources. SAC is "fine-grained access control" that is tightly integrated with the "coarse-grained access control" provided by the Provisioning service. Both the Provisioning and SAC services have been developed, tested and deployed using the RadiantLogic RadiantOne VDS brand name software licenses. There are three RadiantLogic RadiantOne VDS software licenses already being used in production and two software licenses being used in development and testing. Only RadiantLogic or authorized resellers can provide RadiantLogic's proprietary annual software maintenance services and support. These software licenses require uninterrupted and ongoing maintenance and support. Without fully operational RadiantLogic RadiantOne VDS software licenses, serious disruption will occur in the ability of a large user population to efficiently streamline and automate the granting and removing of electronic permissions to VA data, services, technology systems, and resources as well as to enforce both course and fine grain control policies. Specifically, the negative impacts of this degradation in service include a reduction or suspension of the support services that will be experienced by current and planned provisioning and SAC customers which include Veterans, beneficiaries, employees, contractor affiliates, and internal VA users. Finally, the introduction of any brand name other than RadiantLogic will compromise the integrity of Veterans' authorizations that are enabled by the RadiantLogic RadiantOne VDS. VA would need to reorganize, redesign and recode both the provisioning and SAC services. The renewal of RadiantLogic RadiantOne VDS software licenses, maintenance services and support is vital to VA and to ensure RadiantOne VDS software remains secure, reliable, and fully supported. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. It was determined that limited competition is viable among resellers for this brand name effort. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. The justification will be posted with the request for quotation on the NASA SEWP IV GWAC. 7. Actions to Increase Competition: Although the Government is limiting competition as a result of specifying a brand name item, there are resellers of the required maintenance of these products on the NASA SEWP IV GWAC. Limited competition for this requirement among these vendors is anticipated. Finally, in order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to perform additional market research so that other solutions can be considered. 8. Market Research: In December 2013, the Government's technical experts conducted market research to ascertain the ability of any other source, other than a RadiantLogic reseller, that can provide the aforementioned services. It was confirmed that the software currently contains proprietary information and only RadiantLogic and its resellers can provide the annual software maintenance services and support. While other sources possess general capabilities needed to provide similar services, no other source was found to meet VA's needs without access to the proprietary data. Given that the RadiantLogic product is a proprietary solution, there are no other authorized vendors that can provide maintenance licenses without voiding the licenses currently in use. Additional market research was conducted by utilizing the Product Verification tool on the NASA SEWP website. The search identified six RadiantLogic resellers; one Value Added Reseller (VAR) and Computer System Original Equipment Manufacturer from Group A, one Service-Disabled Veteran-Owned Small Business VAR from Group B, three small business VARs (one which is no longer a small business) from Group C, and one large business VAR from Group D. The market research demonstrates that adequate competition exists amongst RadiantLogic resellers on the NASA SEWP IV GWAC. 9. Other Facts: N/A
