Description
The US Army Corps of Engineers, Seattle District, intends to award a sole source single award indefinite delivery indefinite quantity (SATOC)(IDIQ) contract, firm fixed price non-personal services contract to the Kalispel Tribe of Indians, to provide Traditional Cultural Knowledge Assistance Services at the Seattle District U.S. Army Corps of Engineers ( quote mark Corps quote mark ) Albeni Falls Dam and Pend Oreille Lake Project, Bonner County, Idaho. The potential duration of the contract is three years. The authority for this sole-source procurement is FAR 6.302-1. This is a continuation of services previously provided under contract W912DW-10-D-1022 with the Kalispel Tribe of Indians, which expired June 2013. While the intent of this notice is to notify the public of the Government's intent to award a sole source contract, the Government will also review information submitted by those firms who are interested and capable of providing these services. NOTE: The proposed procurement is a successor to past SATOC contracts - W912DW-10-D-1022, for the period June 2010 to June 2013; W912DW-05-D-1019, Cultural Resources Tasks at Albeni Falls Dam and Pend Oreille Lake for the period of June 2005 - June 2009; DACW67-02-D-1003, Cultural Resources Management at Albeni Falls Dam and Pend Oreille Lake Project, Idaho for the period Jan 2002-Nov 2006; and DACW67-97-D-1017, Miscellaneous Cultural Resource Management at Albeni Falls Dam and Pend Oreille Lake, Idaho for the period 1997 - 2001. All of the aforementioned contracts were for identical services sole-sourced to the Kalispel Tribe of Indians pursuant to FAR 6.302-1. This is an ongoing, continuous requirement. Past procurements have been pursuant to the following: ER1130-2-540, Chapter 6, quote mark Cultural Resources Management quote mark as well as the Project's approved Historic Property Management Plan (HPMP); the Federal Columbia River Power System Programmatic Agreement of 6 October 2009; the Programmatic Agreement of 27 November 1991 concerning cultural resource management for the Intertie Development and Use Environmental Impact Statement of April 1988 (IDU PA); and other Acts and Memoranda. Legal, technical expertise, and territorial restrictions limit award of this procurement to a single source. Outside commercial contractors may have the general professional skills that the acquisition requires; however, they would require the cooperation and approval of the Kalispel Tribe to work on the tribal territory and to access tribal historical archives. Firms who believe they possess the capability to perform this work are invited to respond to this notice providing the following information. (1) Company Cage Code, DUNS, name, address, point of contact and applicable telephone numbers and e-mail addresses; (2) Approximate annual gross revenue; (3) Any small business status (General Small Business, 8(a) Small Business, Service Disabled Veteran Owned Small Business, HubZone Small Business); (4) A SPECIFIC PLAN AS TO HOW YOU WOULD MOBILIZE, COORDINATE WITH THE KALISPEL TRIBE, STAFF, MANAGE, AND FINANCE A SERVICE CONTRACT TO PROVIDE THESE SERVICES; (5) Experience you have had in performing similar services, the types of services provided, and the magnitude/extent of services provided. Both Government and Private Sector experience is acceptable; (6) Indicate which NAICS code(s) your company performs under for Government contracts; and (7) Provide proof of association with, cooperation with, and approval of the Kalispel Tribe for your firm to work on the tribal territory and to access tribal historical archives. The following narrative outlines the work necessary by this requirement. General Requirements for the Services. Pursuant to the National Historic Preservation Act (NHPA), PL 89-665, 16 USC 407, et seq, the Corps is required to take into account the effect of its undertakings on any district, site, building, structure, or object included in, or eligible for inclusion in, the National Register (16 U.S.C. 470 f). If the undertaking is found to have an adverse effect on properties, the Corps must consider actions to address the effects, including measures to preserve historic properties. All of the steps in the process must occur in consultation with the associated Indian tribes. The process includes evaluating the significance of the historic properties, and requires access to information about the properties that is in sole possession of Indian tribes, specifically the Kalispel Tribe. Furthermore, the Native Graves Protection and Repatriation Act (NAGPRA), Public Law 101-601, 25 USC 3001, et seq, requires the Corps to consult with Indian tribes immediately following inadvertent discovery of cultural items or ancestral skeletal remains on Federal or tribal lands. NAGPRA also requires the Corps to inventory and repatriate human remains, funerary objects, sacred objects, and objects of cultural patrimony to the affiliated tribes. Special Nature of the Services. In the case at hand, the Historic Properties of Religious and Cultural Significance to Indian Tribes (HPRCSIT) and any items from them are primarily associated with the Kalispel Tribe. The Kalispel Tribe's adjudicated ceded lands include nearly all of the Project's cultural resource sites from Albeni Falls Dam to the Clark Fork River delta, excluding only a small portion with few sites (mainly Euro-American historic) at the extreme southern end of Pend Oreille Lake within the Coeur d'Alene Tribe's ceded area. The Kalispel Tribe also has tribally owned lands at the project with several historic properties and is the primary tribe for NAGPRA inadvertent discovery actions in the subject project areas. In order to evaluate the significance of HPRCSIT, it is necessary to understand the cultural knowledge associated with them. The Kalispel Tribe has confidential information and years of accumulated oral historical knowledge of HPRCSIT within the Project. No other organization has this knowledge and experience. Only the Kalispel Tribe can access the persons having the knowledge of the stories associated with the HPRCSITs. Furthermore, consultation responsibilities of USACE to the Kalispel Tribe when implementing Section 3 of NAGPRA will most likely be accomplished if the Kalispel Tribe is the contractor for dealing with inadvertent discoveries. Materials collected from HPRCSITs during management activities are the property of the Government, but are held in trust for the Kalispel Tribe, except for NAGPRA-eligible items which are directly Kalispel Tribe property. Knowledge of Kalispel perspectives, traditions and cultural practices centered on HPRCSIT at the project is held by members of the Kalispel Tribe, is considered confidential with the Tribe, and is not accessible to others without agreement of the Kalispel Tribe Business Committee. Information provided to the Government as a result of this posting is strictly voluntary and given with no expectation of compensation and clearly provided at no cost to the Government. The relevant North American Industry Classification System (NAICS) code for this requirement is 712120 (Historical Sites) with the applicable small business size standard of $7.0 million in annual gross receipts. Note that the Army Corps of Engineers' email system does not accept files larger than 8MB. The Government is under no obligation to consider information received after 07:00:00 AM Pacific Time US on 17 March 2014 as part of the formal market research for this acquisition. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The Government reserves the right to determine if a SB set-aside is appropriate, as well as one of the targeted socio-economic programs (General Small Business, 8(a) Small Business, Service Disabled Veteran Owned Small Business, HubZone Small Business) based on responses to this notice and other pertinent information gathered by the Contracting Officer. In order for the Government to make a SB set-aside determination, it is emphasized that SB concerns provide sufficient written information to indicate their capacity and capability to successfully perform and manage all the requirements of this effort.
