- JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed-price delivery order issued under a National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC) in support of the Department of Veterans Affairs (VA) Office of Information Technology (OIT). This action is for the renewal of a quantity of 3,000 each GOOD brand name software licenses, the purchase of up to a quantity of 2,000 each of new GOOD brand name licenses, and associated maintenance support. This procurement will ensure that software coverage is maintained for encrypted email for VA mobile devices. The period of performance for this action shall be for a period of 12 months, with one 12 month option period, if exercised. 3. Description of Supplies or Services: The proposed action is for the renewal of a quantity of 3,000 each GOOD brand name software licenses, the purchase of up to a quantity of 2,000 each of new GOOD brand name licenses, and associated maintenance support. GOOD is an email client for government smart phones that provides Federal Information Processing Standard (FIPS) 140-2 protection for data at rest and in motion. In addition to licenses, the Contractor shall provide software maintenance that provides continuous 24x7 access to product updates and upgrades; uninterrupted access to technical support via phone and email; and uninterrupted access to on-line technical resources. The total estimated price of the proposed action is 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), "only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on extensive market research, as described in paragraph 8 of this document, it is determined that limited competition is available among resellers for GOOD brand name software. GOOD brand name software is the only software application separated by a sandbox environment keeping Government data separated and protected in a FIPS 140-2 certified solution, providing the ability to encrypt data in an "at rest" state and in data transit without relying on active synchronization or its own device encryption. Further, GOOD is the only FIPS 104-2 certified solution (certificate #1247) approved by the Defense Information Security Agency (DISA), with a Security Technical Implementation Guide (STIG), for use with Windows Mobile, iPhones, iPads, Palm Operating System, and Nokia Symbian that can meet VA's requirements. This policy is outlined in VA memorandum VAIQ #7292407, paragraph 2, which states that all applications must be FIPS 140-2 validated. Based on the above analysis, the procurement of a brand name product other than GOOD cannot meet the Government's technical requirements. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2) the contract award will be synopsized on the Federal Business Opportunities (FedBizOps) Page. In addition, this Justification for an Exception to Fair Opportunity will be made publicly available on the FedBizOps Page and posted on the NASA SEWP IV website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any products available that will enable future requirements to be competed. 8. Market Research: The Government's technical experts researched other products such as Apple Native Mail and Airwatch Mail and it was determined that proceeding with another brand would impact the security of sensitive email being sent to and from VA mobile devices. Apple Native mail recently became FIPS compliant, however it requires mailbox Activesynch to be enabled. If Activesynch were turned on, then email containing Personal Health Information (PHI)/Personally Identifiable Information (PII) would be accessible by any device, not just those that are authorized. This would mean that protected email would be viewable by untrusted devices, which violates VA security policies. Additionally, VA is testing Airwatch Mail for use in the current exchange, however it is not currently FIPS compliant and is therefore not compatible. However, once it becomes FIPS compliant, it could be a viable solution to meet VA's needs. 9. Other Facts: N/A
