Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, VISN 8, Veterans Administration Caribbean Healthcare System, San Juan, PR. Req. 672-14-2-2510-0114 2 Nature and/or Description of the Action Beina Processed: This is a request for other than full and open competition for the emergency procurement of services to perform Emergency Repair Services on the Variant Linear Accelerator Unit (TRILOGY) located at Radiotherapy Section. This Linear Accelerator is used to perform Radiotherapy treatments on Cancer patients. This action will be awarded as a new firm-fixed-price purchase order. 3 Description of Supplies/Services Reauired to Meet the Aaencv's Needs: Contractor will provide all necessary Repair Services and parts to bring this unit to Manufacturer Specifications. This is in order to comply with the requirements of VHA directive 2009-004 and TJC regulations. Total value for repair is $15,291.04. 4 Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1 (b) (2) The existence of limited rights in data, patent rights, copyrights, or secret processes ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5 Demonstration that the Contractor's Uniaue Qualificati ons or Nature of the Acauisition Reauires the Use of the Authority Cited Above (applicability of authority): VARIAN is the proprietor and Manufacturer that Service and repairs their manufactured Linear Accelerators. It is a company that complies with FDA Regulation Standards and will bring this unit to manufacturer specifications. 6 Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Limited market research was performed and find out the there is only one source that can perform this task to the service specific need. 7 Determination by the Contractina Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price to the Government is $15,291.00. Rice is fair and reasonable in comparison with current market value. Repair or replacement parts price is not included. 8 Description of the Market Research Conducted and the Results. or a Statement of the Reasons Market Research Was Not Conducted: A limited market research was conducted due to the facts that delays to perform the Repair Services on the Linear Accelerator will delay treatment even more than already is. 9 Any Other Facts SuDoortina the Use of Other than Full and Open Competition: This item is for direct patient care. Failure to obtain in timely manner will result in a threat to health, welfare and or safety. It will decrease VACHS ability to provide critical care in the Radiotherapy Department and will extend treatment, furthermore increasing operational cost to the Government. Apart from the actual urgency to perform Repair Services on this unit; all parts will be provided by VARIAN. 10 Listina of Sources that Expressed. in Writing. an interest in the Acauisition: See section VI above. 11.
