- The Food and Drug Administration (FDA)/Office of Acquisition and Grants Services (OAGS) is seeking communication services where the Contractor shall develop protocols and collaborative pathways with Tribal Governments and organizations. OAGS is performing the acquisition on behalf of the FDA Center for Tobacco Products (CTP), Office of Compliance and Enforcement (OCE) located in Rockville, Maryland, 20850. The Contractor will be utilizing information provided by the Government to develop a strategy for a subset of the over 500 federally recognized Tribes, as determined by the Bureau of Indian Affairs. All requirements and deliverables shall relate to and consider only federally recognized Tribes as determined by the Bureau of Indian Affairs. The Contractor shall assess and explore viable avenues and recommend protocols for working with each Tribal nation that has one or more FDA-regulated tobacco businesses, regarding areas of compliance with the Tobacco Control Act and its enforcement. Enforcement may include traditional enforcement activities, conducted throughout the United States by or on behalf of FDA, such as tobacco retail inspections and/or compliance training, education, and outreach activities. The Contractor will not perform any actual enforcement activities but will identify retailers and manufacturers, research Tribal programs, and recommend methods of working with and effectively communicating compliance-related information to Tribes. Much of the work will take place at the Contractor's location, however the Contractor shall occasionally be required to travel to various states across the country. This procurement is being processed in accordance with FAR Part 15, Contracting by Negotiation. The North American Industry Classification System (NAICS) code for this requirement is 541611, Administrative Management and General Management Consulting Services, which carries a small business size standard of $14 million. The forthcoming solicitation for this requirement will reference that the requirement shall be a Total 100% set aside for small business. It is anticipated that a Time and Materials (T&M) contract with a base year and one additional option year will be awarded from forthcoming solicitation FDA_14-223-SOL-00042. The total value of the base year plus one additional option year is expected to be between 1-2 million dollars. The solicitation will require firms to demonstrate experience and understanding of the requirements and the steps/processes that will be carried out in order to ensure successful performance. An award will be made to the responsible offeror whose proposal, as it conforms to the solicitation requirements, represents the best value to the Government in terms price, past performance and other non-price related factors. The solicitation will be available by INTERNET ACCESS ONLY. All solicitation documents and amendments thereto will be posted on the FEDBIZZOPS. The solicitation is expected to be available for review on the website on or around 14 April 2014; the closing date will be thirty days after posting. It shall be the contractor's responsibility to regularly check the website for any amendments or related postings to the solicitation. Contractor is required to be registered in System for Award Management (SAM) https://www.sam.gov/portal/public/SAM/#1 in order to be eligible for award. No contract award will be made to any contractor that is not already registered or in the process of registering.
