- 40-1 V509731Y Sole Source Justification This Notice of Intent is NOT a Request for Proposals (RFP) for competitive proposals; however, the Federal Emergency Management Agency (FEMA) intends to award a sole source contract based on the authority of FAR 6.302-1 "Only one responsible source and no other supplies or services will satisfy agency requirements." FAR 6.302-1(b)(1) states this authority shall be used, "When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by -- (i) Unique supplies or services available from only one source or only one supplier with unique capabilities...". FEMA intends to award this contract to Advanced Power Control, Inc. (APC) by Schneider Electric IT Corporation for Extended Warranty Support (UPS Units) which are considered commercial services in accordance with FAR Part 2. This action is being performed in accordance with FAR 6.302-1(a)(2) which states, "When the supplies or services required by the agency are available from only one responsible source,..., and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." A Sole Source Justification submitted by the Contracting Officer's Representative (COR) and approved by the Contracting Officer is on file in FEMA's National Continuity Acquisition Branch office and attached to this notice. DHS/FEMA/MWEOC, Information Technology Section has a requirement to service/warranty components of the existing CF1B UPS units located at the Mt. Weather Emergency Operation Center (MWEOC). This requirement includes a one year advantage ultra service plan, one stand alone PM visit for one UPS 41 to 150 kVA and one year advantage ultra service plan for one Symmetra PX UPS 80kVA or 100 frame UPS and/or PDU. The requirement also includes one year 4 hour response upgrade to existing service contract for one cooling product, 7x24 scheduling upgrade from existing preventative maintenance service, scheduling upgrade to 7x24 for existing PM or additional PM visit for 41 to 150 kVA, and one year 4 hour 7x24 response upgrade to factor warranty or existing service contract for 41 to 150 kVA. The estimated period of performance to complete these services is 12 calendar months from date of contract award. A portion of the equipment to be upgraded under this requirement is located in a classified area which requires a TOP SECRET security clearance to access. Contractor personnel with active TOP SECRET clearances and a TOP SECRET level contractor facility clearance will be required. APC by Schneider Electric is currently performing preventive and remedial maintenance on UPS equipment located at the DHS, FEMA, MWEOC. Their service technicians are factory trained to replace/upgrade MWEOC's existing UPS equipment. In addition, APC by Schneider Electric technicians have the required TOP SECRET clearances and APC has a facility clearance at the TOP SECRET level. Thus, in accordance with FAR 6.302-1, APC by Schneider Electric is considered the only responsible source capable of satisfying DHS/FEMA's requirements to service/warranty components of the existing CF1B UPS units located at the MWEOC. DHS/FEMA is unaware of any other sources capable of providing services to service/warranty components of the existing CF1B UPS units and capable of providing TOP SECRET cleared technicians, as well as a TOP SECRET level contractor facility clearance. However, any company capable of providing an equivalent level of service may submit a detailed capabilities statement in order to allow the Government to perform an evaluation of your proposed capabilities/qualifications. This information should be emailed to Ryan.Owings@fema.dhs.gov, or faxed to 540-542-2631, no later than 12:00 PM on March 12, 2014. Capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government.
