Description
The Department of Veterans Affairs, VISN 21, Network Contracting Office 21, intends to negotiate a sole source contract Base Year, Plus 1 Option Year with Laura Wald to create scope and structure for mobile apps; create content for mobile apps for Veterans who have experienced trauma and/or have PTSD; and create supporting documents for successful dissemination of mobile apps throughout federal agencies. All work will take place at the VA Palo Alto Healthcare Facility, 3801 Miranda Ave., Palo Alto, CA 94304 This procurement is being conducted in accordance with FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c) (1)). Contract is firm fixed price and the NAICS Code is 811219. This Notice of Intent is not a request for competitive proposals. No solicitations documents are available and telephone requests will not be honored. However, if a firm believes it can meet the requirements it must furnish information about its products and services, as well as references from other customers who are using these products or service, to the Contracting Officer within three (3) calendar days from the date of publication of this synopsis. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirements. Information must be sent via e-mail only to the Contracting Officer at Rusty.Stevenson@va.gov. Responses received will be evaluated however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. DEPARTMENT OF VETERANS AFFAIRS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.Contracting Activity: Department of Veterans Affairs, NCO 21; 2615 E. Clinton Avenue, Fresno, CA 93703. 2.Nature and/or Description of the Action Being Processed: Justification and approval for Other than Full and Open Competition for content development services for mobile applications to be used by Veterans and Civilians who have experienced trauma and/or have Post Traumatic Stress Disorder (PTSD). Work is located at the National Center for PTSD, VA Palo Alto Medical Center, 3801 Miranda Ave., Palo Alto, CA 94304. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Contractor shall provide content development services for mobile applications for mental health. The current project aims to create and support a suite of clinical software applications for mobile phones that can be used by Veterans and civilians who have experienced trauma and/or have PTSD. The contractor will be responsible for creation of original content for these applications, design of same, creation of basic technical specification documents, communication with VA stakeholders, iterative testing process, and creation of supporting materials used to disseminate the resulting applications. 4. The total estimated amount of service Base Plus 1 Option Year $120,000. NAICS 541511, Custom Computer Programming Services, Size Standard $25.5 Million 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c) (1)). 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The National Center for PTSD, VA Palo Alto Health Care Facility has multiple years of past experience working with Dr. Laura Wald. Dr. Wald has been a DoD contractor developing web apps and mobile apps for years. Since VA has posted only 6 mobile applications to iTunes in the past 3 years, all of which came from either Dr. Wald or the VA Palo Alto National Center for PTSD Team, VA is certain no other individual and/or firm has the experience level required of the rigorous and idiosyncratic certification process for mobile applications. VA requires a single content expert with both expertise in mental health (diagnosis, research methods, treatment) and mobile delivery of tools (including the software development process). Finding a new firm or individual is not only highly unlikely, but would result in increased cost and untimely performance. Market research results yield no psychologists or psychiatrists with the qualifications required for this scope of service. Multiple individuals have been given opportunities to meet this requirement in the past only to be removed from the position for failure to perform because such a specific skill set is required. There is no other vendor or individual that can successfully perform this service based on the scope of work and requirements. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Notice of intent to sole source with description of requirement shall be posted to FedBizOps www.fbo.gov, the official Government Point of Entry. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Service has been performed by Dr. Wald in recent years and pricing remains consistent even with regards to inflation. An Independent Government Estimate (IGE) was established based on historical data and pricing is deemed fair and reasonable as compared to the IGE. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Notice of intent to sole source with description of requirement shall be posted to FedBizOps www.fbo.gov. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No actions will be taken to overcome barriers to competition. Other firms and individuals claimed to have the knowledge, skills, and abilities to perform this service and each have failed, which has resulted in time and money lost. It would require significant financial resources, time, and personnel to reach the current level achieved by Dr. Wald and the National Center for PTSD, VA Palo Alto HealthCare Facility. There is no other vendor that can successfully perform this service based on the scope of work and requirements. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
