- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm-fixed price task order issued under the National Aeronautics Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC) for the procurement of brand name NetApp 24X7X365 on-call, four hour response on-site support and annual software maintenance for the NetApp operating system. This requirement also includes maintenance for existing NetApp high speed switches and will provide support and clustering functionality required by the Department of Veterans Affairs (VA) Genomic Informatics System for Integrative Science (GenISIS). GenISIS and the Million Veterans Program (MVP) is an initiative for transforming healthcare through the VA Office of Research and Development (ORD). Personalized medicine and large scale genomic research have been established as strategic initiatives for the Veterans Health Administration (VHA) and VA ORD. Personalized medicine describes the use of biological information to determine the right treatment, at the right time, for the right patient. It represents an important advancement over today's current understanding of human health and VA has determined it critical to lead the discovery and implementation of personalized medicine to the benefit of VA healthcare systems. The period of performance for this action is 12 months. 3. Description of Supplies or Services: The required hardware and software maintenance of the existing NetApp switches enable uninterrupted use for managing research and development project data within the MVP at VHA's Boston Jamaica Plain Campus. The MVP team currently uses NetApp storage products, switches and software as its storage infrastructure in support of GenISIS. Currently there are 1.5 petabytes of raw storage installed. The purpose of this order is to allow for the support and high availability of 1.5 petabytes of existing storage already implemented in support of GenISIS. The 24X7X365 on-call, four hour response on-site support, annual software maintenance for the NetApp operating system, and NetApp certified high speed switches to support clustering mode will allow for higher throughput for genomic sequencing data for analysis by research personnel. The total estimated price of the proposed action is 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. The proposed action is for the procurement of maintenance and support of existing NetApp software and hardware that is being integrated with existing and installed NetApp switches. The software maintenance services provide on-call and onsite support, bug fixes, patches, security updates, and upgrades to the NetApp proprietary operating system that manages the GenISIS storage infrastructure. In January 2012, VA made a $687,000 investment in NetApp hardware and software through a competitive procurement. The cost of new hardware and software would be approximately the same as the $687,000 paid in January 2012. Further, acquisition of new hardware and software would require VA to incur additional implementation costs, to include the training of personnel to manage the new hardware and software, and the migration to the production environment after completing development testing with the new hardware and software solution. None of the additional cost above would be recovered through competition. Furthermore, no companies other than NetApp or their authorized resellers possess the proprietary information necessary to provide the required maintenance to the NetApp operating system and corresponding software. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2) the contract award will be synopsized on the Federal Business Opportunities (FedBizOps) Page. In addition, this Justification and Approval (J&A) will be made publicly available on the FedBizOps Page and posted on the NASA SEWP IV website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government's technical experts will continue to perform market research to determine if there are any suites of products available that will enable future requirements to be competed. 8. Market Research: Market research was conducted from June 2013 through December 2013 by searching product websites of NetApp, EMC and Isilon systems. Each vendor offers only a proprietary system that will only operate with their approved hardware and software. This market research revealed that only NetApp, or authorized NetApp resellers would be capable of providing the support and annual software maintenance necessary for the existing NetApp solution. Only NetApp certified software is compatible and can integrated into a proprietary NetApp system. 9. Other Facts: None.
