Description

The U.S. Department of Commerce, National Institute of Standards and Technology's Office of Acquisition and Agreements Management (OAAM) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b)(1), with CCH Incorporated. The Government intends to purchase a license for the delivery of the TRDaily newsletter electronically 5 days/week (except for Federal Holidays). The National Telecommunications and Information Administration (NTIA) will distribute the publication to up to 70 NTIA employees. Distribution to staff will be via NTIA's listserv, which will serve to control the number of permissible subscribers. This is a proprietary TRDaily publication. Award of a single Firm-Fixed Price Purchase Order is contemplated with a period of performance of March 1, 2014 through February 28, 2015. The source code is 76, the North American Industry Classification System (NAICS) code for this request for quotation is 511130. The North American Industry Classification System (NAICS) code cited in this sources sought notice is for internal business size stratification purposes only, and is not meant to restrict this procurement to small business. The statutory authority for other than full and open competition is 41 USC 253(c)(1) as implemented by FAR 6.302-1, Only one response source. This is not a solicitation for competitive quotes; however, if any other interested party believes that they can meet the requirements, they must submit a statement of capabilities, which if timely received, will be considered by NIST OAAM. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NIST to determine if the party can meet all of the foregoing requirements. Responses must be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the capabilities statement meets all of the foregoing requirements. Capability statements and related materials must be e-mailed to Alicia.Henson@nist.gov by February, 25, 2014, at 10:00AM EST. The determination to compete or not to compete the proposal contract based upon responses to this notice is solely within the discretion of the Government. The information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
