Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. ADDENDA TO FAR 52.212-1 INSTRUCTIONS TO QUOTERS - COMMERCIAL ITEMS In accordance with FAR 12.302, Tailoring of Provisions and Clauses for Acquisition of Commercial Items, FAR Clause 52.212-1 is tailored as follows to reflect special contract terms and conditions that are unique for this contract. A. DESCRIPTION OF THE PROGRAM: 1. The U.S. Army Corps of Engineers (USACE), Learning Center (ULC), is tasked to develop, update, or revise, and present professional development training to employees located around the world through various modes of delivery. 2. This contract is designed to provide classroom training on 2014 National Electrical Code Changes 2014 National Electrical Code Changes 10-14 March 2014 The Tom Bevill Center Huntsville, AL INSTRUCTIONS TO QUOTERS: 1. Quoter must provide pricing for all items for the quote to be acceptable. 2. Quoted items shall meet all requirements of the Request for Quote (RFQ). 3. Contractor's quote shall include the company name and address, and shall include a point of contract's telephone number and email address. 4. Quoter must submit an electronic copy of quote to the Contract Specialist, Cynethia McDonald, at Cynethia.Crawford-McDonald@usace.army.mil and the Contracting Officer, Zalerie Moore, at Zalerie.Moore@usace.army.mil. The quote shall be submitted in PDF format. All questions shall be submitted by 1:00pm CST, 18 February 2014. Your quote shall be due by 4:00pm CST, 21 February 2014. B. ACQUISITION APPROACH 1. This is a quote mark best value quote mark competitive acquisition for the award of a firm-fixed price (FFP) contract. Award will be made to the best overall proposal, which is determined to be the most beneficial to the Government. 2. The Government will evaluate proposals in accordance with the criteria described herein, and award contract(s) in accordance with procedures in FAR 13.106-2. EVALUATION FACTORS: FACTOR 1: QUALIFICATIONS -Instructor's must provide proof of certification and demonstrate that its proposed classroom instructor(s) (meet(s) at least the MIMIMUM educational requirements of a bachelors degree in civil, geotechnical, construction or a related engineering area. FACTOR 2: WORK EXPERIENCE - The Work Experience evaluation will assess the relative risks associated with a quoters' technical experience in the subject matter area 2014 NEC changes. The Government will assess work experience on whether it is recent and relevant. The quoter must demonstrate at least ten (10) of experience in National Electrical Code Changes. The contractor shall submit three (3) projects that have occurred or been performed within the last ten (10) years and they must be of similar size, scope and complexity to the effort described in the PWS. The quoter shall provide a description of the projects, the size of the efforts, dollar value, and an explanation of how they are similar in size, complexity and scope to the PWS. FACTOR 3: TEACHING EXPERIENCE - The Teaching Experience evaluation will assess the relative risks associated with a quoters' instructional experience in the subject matter area 2014 National Electrical Code Changes. The Government will assess teaching experience on whether it is recent and relevant.. The quoter must demonstrate at least ten (10) of experience in National Electrical Code Changes. The contractor shall submit three (3) projects that have occurred or been performed within the last ten (10) years and they must be of similar size, scope and complexity to the effort described in the PWS. The quoter shall provide a description of the projects, the size of the efforts, dollar value, and an explanation of how they are similar in size, complexity and scope to the PWS. FACTOR 4: PAST PERFORMANCE - The Government will evaluate the quoter's likelihood of success in performing the solicitation's requirements and delivering high quality products and services as indicated by that quoter's record of past performance. In this context, quote mark quoter quote mark refers to the proposed prime contractor and its proposed key subcontractors. Past performance of prime contractors or key subcontractors whose firms are divided into severable segments (i.e. division, group, unit, etc.) will only be evaluated as it relates to those segments of the firm(s) that will actually perform the work. The quoter shall submit three (3) past performance references for the three (3) projects submitted under Factors 2 and 3 above. The references shall complete the attached Past Performance Questionnaire. There are four levels of relevancy as shown in the bullets below. More relevant past performance will typically be a stronger predictor of future success and will therefore have more influence on the overall performance confidence assessment than past performance of lesser relevance. Very Relevant: Past performance effort is recent and involved essentially the same scope and complexity this solicitation requires. Relevant: Past performance effort is recent and involved similar scope and magnitude of effort and complexity this solicitation requires. Somewhat Relevant: Past performance effort involved some of the scope and complexity this solicitation requires. Not Relevant: Past performance effort is not recent and/or involved little or none of the scope and complexity this solicitation requires. The Government may elect to consider data obtained from sources other than those identified by the quoter. In the event that adverse past performance information is obtained from other sources, the quoter will have the opportunity to respond to any adverse information received which it had not had a previous opportunity to comment. If the Government does not receive past performance information and cannot establish a past performance record for the quoter, or if the quoter has no past performance record, the quoter will be given an quote mark Unknown Confidence quote mark assessment rating. FACTOR 5: PRICE - A firm fixed price contract will be awarded to the quoter whose quote meets or exceeds all evaluation criteria. The contract award will be to the responsible quoter whose quote represents the best value and will be the most advantageous to the Government considering the evaluation factors listed herein. The proposed price will be evaluated for reasonableness and realism. Proposals found to be unreasonably high or unrealistically low may be considered unacceptable and may be rejected on that basis. The Government will evaluate the realism of the prices to determine whether the price is realistic for the work to be performed; reflects a clear understanding of the requirements; and is consistent with the methods of performance described in the proposal. If the price is deemed to be unrealistic in any of these respects, the Government will factor this consideration into the applicable non-price ratings. The agency may reject a quote that reflects a lack of price realism. The Government will only award the required contract if a fair and reasonable price can be obtained. The Government may conduct negotiations to determine a fair and reasonable price while taking into consideration other non-price factors, which are of more importance than price. However, it is the Government's intent to award without discussions. The quoter shall provide a completed and signed Standard Form 1449, and identify someone who is authorized to negotiate on behalf of their firm and sign contractual documents. The quoter shall also provide an excel document demonstrating how the FFP for labor is devised (i.e. what labor categories, fixed rates, estimated hours, etc.) and how travel is estimated. RESPONSIBILITY RELATED INFORMATION 1. In accordance with FAR 52.219-14 - Limitations on Subcontracting: This clause applies to contracts that have been set aside or reserved for small business concerns. At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern. The offeror shall provide a statement on how it will achieve compliance with FAR 52.219-14 during the life of the contract in his proposal. In accordance with FAR 52.219-8 - Utilization of Small Business Concerns, it is the policy of the United States that its prime contractors establish procedures to ensure the timely payment of amounts due pursuant to the terms and their subcontracts with small business concerns, veteran-owned small business concerns, service-disabled veteran-owned small business concerns, HUBZone small business concerns, small disadvantaged business concerns and women-owned small business concerns. The offeror shall provide a statement on how it will achieve compliance with FAR 52.219-8 during the life of the contract in his proposal. Joint Venture - When proposing as a joint venture, all members of the joint venture shall sign the SF 1442 unless agreement by the joint venture is furnished with the proposal designating one firm with the authority to bind the other member(s) of the joint venture. In addition, a copy of the joint venture agreement shall be submitted with the proposal and will be evaluated in accordance with applicable regulations. Failure to comply with the foregoing requirements may eliminate the proposal from further consideration.
