- The Mission and Installation Contracting Command (MICC), Fort Bliss, TX is seeking potential sources to procure privately operated jail services near twenty-five (25) miles from Fort Bliss, TX. This is a Sources Sought announcement ONLY and not a pre-solicitation; therefore, a Contractor should not construe it as a commitment by the Government. A solicitation is not available at this time; therefore, any requests for a solicitation will not receive a response. This is a Sources Sought announcement seeking only qualified small businesses (e.g., small business, 8(a), service-disabled veteran owned small business, HUBZone small business, small disadvantaged business, veteran-owned small business, economically disadvantage woman owed small business, and women-owned small business) responses in order to determine Small Business participation in this acquisition. Management responsibility of the contractor will adhere to Army Regulation (AR) 190-47, The Army Corrections System, dated 15 June 2006, Chapter 3-2(i): Installations are authorized to contract to incarcerate pretrial prisoners in federally approved local civilian jails when military facilities are not available. Federally approved is defined as a facility used or approved by the Federal Bureau of Prisons, U.S. Marshals, or Immigration and Customs Enforcement and it is accredited by American Correctional Association (ACA). Installation commanders may authorize contract will local jails for prisoners with sentences to confinement of thirty (30) or fewer days, followed by notification of Department of the Army, Provost Marshal General (DAPM), of such action. Local jails may not be used to confine sentenced prisoners beyond thirty (30) days without prior approval from DAPM. Agreements with civilian jurisdictions will provide for the segregation of pretrial Army prisoners by officer, noncommissioned officer, and enlisted, sex, and post trial status. Copies of agreements will be forwarded to Department of the Army, Provost Marshal General (DAPM). This Sources Sought is requesting for all functions, tasks and responsibilities normally performed by the contractor when confining military prisoners from Fort Bliss, TX. The Contractor shall be responsible for the objective of this contract is to have the contractor provide all facilities, personnel, supervision, equipment, and material (except those provided by the Government as specified in the Performance Work Statement (PWS)'s paragraph B.3 necessary to confine military prisoners from Fort Bliss. All work performed shall be in accordance with the PWS and Federal, State and local laws or Court orders applicable to the operations and administration of prison, confinement and detention facilities. The contractor shall perform in accordance with the standards, policies and procedures of the American Correctional Association, the National Commission on Correctional Healthcare and Army Regulation (AR) 190-47. The Contractor shall comply with all applicable laws and regulations, including but not limited to Federal Law, New Mexico and Texas State Law(s), Occupational Safety and Health Administration (OSHA) regulations, Army and installation regulations. The Government anticipates the award of a Firm Fixed Price contract to the successful offeror of this requirement. The period of performance is for a one (1) base year period of twelve (12) months [beginning 25 September 2014 and ending 24 September 2015] with four (4) 12-month option years. All work is to be performed in accordance with the Performance Work Statement. The designated North American Industry Classification Systems (NAICS) Code for this procurement is 561210, (Jails, privately operated), with a small business size standard of $35.5 million. Your response shall include the following information: Your DUNS number or CAGE code, your small business status (i.e., small business, 8(a), HUBZone, WOSB, VOSB, SDVOSB, etc.), revenue for last three years, relevant past performance on same/similar work within the last three years, and your company's capability to do the work. Documentation of technical expertise and capability must be presented in sufficient detail for the Government to determine that your company possesses the necessary functional area expertise and experience to compete for this acquisition. It is imperative that business concerns responding to this sources-sought articulate their capabilities clearly and adequately. Responses should not exceed five (5) pages in length. It is incumbent upon the interested parties to review the site frequently for any updates and amendments to any and all documents. All potential offerors are reminded, in accordance with FAR 52.204-7, System for Award Management; lack of registration in the System for Award Management (SAM) at https://sam.gov will make an offeror ineligible for contract award. Additionally, in accordance with Federal Acquisition Regulations (FAR) 52.204-8, Annual Representations and Certifications, offerors are also reminded to register with System for Award Management (SAM) This notice shall not be construed as a commitment by the Government to ultimately award a contract, nor does it restrict the Government to a particular acquisition approach. Any information provided by industry to the Government as a result of this notice or any follow-up information requests is voluntary and shall be treated as confidential. No reimbursement will be made for any costs associated with this or future requests.
