- The Department of the Navy, Space and Naval Warfare Systems Command (SPAWAR) intends to issue a contract modification to Hewlett Packard Enterprise Services (HPES) under contract N00039-10-D-0010 covering the period from 1 July 2014 through 30 September 2014. This contract modification will also increase the contract ceiling as established in modification P00060 from $5,603,792,250 by $138,000,000 to a new ceiling amount of $5,741,792,250. This notice of intent is not a request for competitive proposals or quotes. A determination by the Government not to compete based upon responses to this notice is solely within the discretion of the Government. Authority for other than full and open competition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1, only one responsible source and no other suppliers or services will satisfy agency requirements. The incumbent provider, Hewlett Packard Enterprise Services (HPES) is the only responsible source able to satisfy DON requirements at this time. No alternative source can ensure continuity of service without major disruptions. HPES currently owns and/or controls most of the critical infrastructure and computer software used to provide NMCI services. The DoN has actively worked to remove barriers to competition including purchasing Government Purpose Rights to HPES NMCI Intellectual Property and including options to buy HPES owned hardware and infrastructure. These steps allowed full and open competition for NGEN. HPES is the awardee of NGEN contract N00039-13-D-0013. However, due to a delay in contract award and subsequent protest, the CoSC period of performance is not aligned to the NGEN transition schedule. The aforementioned options will allow the Government to continue NMCI services for those sites which have not yet transitioned.
