GE Service Agreement Capabilities/Benefits PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the Division of Intramural Research (DIR) intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to GE Healthcare Biosciences, 800 Centennial Avenue, Piscataway, NJ 08855 for a maintenance agreement to maintain the Deltavision OMX super-resolution microscope. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $19.0 million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-72. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. DESCRIPTION OF REQUIREMENT Background A Deltavision OMX super-resolution microscope in the NHLBI DIR is in need of a one year Service Maintenance Agreement (SMA). This microscope is owned by the Light Microscopy Facility in the DIR and is used on a daily basis to perform optical microscopy experiments for many NHLBI researchers. Many researchers in the DIR rely on this microscope for their day to day imaging needs. This microscope is a very complicated and delicate scientific instrument that requires access to knowledgeable engineers to maintain performance standards and to fix problems as they occur. Purpose and Objectives The Light Microscopy Facility in the NHLBI DIR is looking for a Service Maintenance Agreement (SMA) to cover a Deltavsion OMX super-resolution microscope (serial # OM06044, NIH decal # 01910518) for a one year agreement. The SMA should cover onsite and/or offsite repair, labor, parts, and travel costs associated with keeping this microscope properly working. The company that provides this service must have the knowledge and the capability to keep these microscopes in good working order. Period of Performance Maintenance agreement period of performance: 2/11/2014 - 2/10/2015 Project Description The contractor will be required to fix this microscope on an ad hoc basis as required. This will include onsite and/or offsite repair, labor, parts, and travel costs associated with keeping this microscope properly working. The Contracting Officer's Representative will be required to contact the contractor when work is required and to verify that the work was done to the appropriate standards required. Reporting Requirements and Deliverables The contractor will provide a report of what was done for each service visit and answer questions and demonstrate that the microscope has been fixed and is in proper working order. Validation, Inspection and Acceptance Requirements The Contracting Officer's Representative will verify that work done on the microscope was completed and that the microscope is in good working order. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the Sole/Single Source Justification that is attached to this Notice of Intent. Only GE Healthcare (which owns Deltavision) has the proprietary knowledge to fix and maintain this microscope. No other company can provide this service. This is a very complicated microscope that enables very high resolution experiments. Only Deltavision as a subsidiary of GE Healthcare can service this microscope and maintain its functionality. This SMA must be purchased through GE Healthcare as a sole source order. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by 3:30 PM EASTERN TIME February 10, 2014 and must reference number NHLBI-CSB-HL-2014-66-KBM.
